Is carry legal in polling places?

You can not legally carry in a polling place.

Incorrect. Carry in a polling place is legal as long as the building is not posted or the place is not otherwise off-limits (schools, etc.).

As the signs sent from the election commission, to each polling location include signs to prohibit weapons during polling, I'm not going to be the court case to challenge it.

Well as was said, if they are posted with signs that conform to 39-17-1359 or at schools, then yes a polling place is off-limtis.

However there is no laws that says polling places themselves are off-limits.

None of the polling places I have been to around my county have been posted....

I guess it is different from county to county if they choose to post or not.

Bottom line...

  • If the polling place is in a normally prohibited location, then you cannot carry.

  • If the polling place is posted, then you cannot carry.

  • If neither of the preceding are true, then you may carry unless spotted and told not to. Then you must obey their directive and either disarm or leave.
