The effect of putting the Solicitor General on the Supreme Court

Justice Kagan has recused herself from 25 of the 51 cases heading to the Supreme Court, due to the fact the Solicitor General Office, by default, has to defend against Constitutional challenges to Federal Law and policy.

The negative effect: She will not be available for over half the present term.

The positive effect: She will not be available for over half the present term.

(She will not get to aid in deciding, or writing the opinion, for those 25 cases - and she is a liberal judge - beneficial if any of the 25 cases are 2nd A related...)

Thoughts?

Summed it up quite well. I just got through reading that article. I didn't

know they recused themselves like that at the level of SCOTUS. At

least its honest. And I'm sure glad they don't call up retired justices to fill

recusal vacancies.

She should have recused herself from the confirmation hearings by not

accepting the nomination. I would be happier.

Better yet, she (once she rules, and proves her Senate testimony was false) and Sonia Sotomayor (she's already proven her testimony was a complete fabrication) should face perjury charges for pretending to be followers of the Constitution and the rule of law as written. For those of you who are the praying type, I'd request that you add John Roberts, Antonin Scalia, Clarence Thomas, and Samuel Alito to your list (and even perpetual weathervane Anthony Kennedy - he's on the side of the good often enough that we need him) for the next 2-6 years.

Or any other Amendment for that matter.

Yep, don't exclude Kennedy. He already said he would postpone retirement until

the end of this administration. It would be a just act to remove those two women

because of what you said. They're part of the war from within, against this country.
