That may be true, but if he has to buy a replacement then he has to pay tax on it, so it should be included in the estimated value.

Not really....

I mean it should be included in replacement cost when figured on by the insurance company or by the judge of restitution. But tax doesn't increase the actual value of an item.

That is true. I just misread it to read "can't get tax, you have to pay it" and wanted to throw my uneducated 2 cents in there. ;)

I was at chilhowee park yesterday to see the demolition derby and had to leave my weapon behind, but my trunk can ONLY be opened with a key.

I was talking to my friend there and knoew someone who had valuable in there trunk and there was a interior trunk pop that had a key lock, criminals broke the lock and popped his trunk open and stole his goods

don't expect a plastic locked glove box to do much.

I keep my pistol case in the car so that I can put it in the case and open the trunk with my key and leave it in there or take in out as needed

either get a bolt to the floor safe or disconnnect/disable easy trunk openers so that the trunk can only be opened with a key like the old tank cars were.

Sorry to be late on board for this. The 9 bucks extra he gave you was for the ammo I think.

However I agree, replacement cost should include what a person actually had to pay out of pocket.

Party A damages Party B.

Party A is ordered to pay Party B's damages.

Party A should have to pay what it takes to put party B back in the same shape Party B was in before the event.

In this case, if Insurance is covering damages, minus say 150. I count the damages to include taxes that have already been paid.

Man that sucks, even if you were to get it back tomorrow with everything you have had to go though it totally sucks.

Dude, sorry to hear the bad news. I know how mad :P you must be.

Some punks broke into my car once and took zilch (nothing in there worth stealing), but they had a "cute" lil signature. They were breaking/bending gear shifts and/or taking the gear shift knobs of the cars they broke into.

I hope the Police catch who did it and they fall down a LOT before they get back to the station :eek:.

BTW...what happens if the insurance comes thru and then the gun turns up? Do you have to give back the money the insurance paid?

That's my question... I don't think so.. but IDK. If it does get back, I'm not gonna call up the Insurance Co and ask them.. :eek:

Well it's like a car being totaled, once they pay you for it, it's theirs. You may be able to buy it back from them for a "discounted" price but it would actually belong to them. In all probality you will not see the gun for a while and when/if you do it could very well be trashed (all scratched up, etc.) which would lower the value quite a bit.

Say for instance, cops findit ona robbery suspect, he drops it on the ground, when they cuff him they kick it around on the pavement, then it's kept 3 years in the evidence room. Once it's returned to you it would be worth very little. Call the insurance company, tell them that it was returned to you but in whatever condition it actualy is in. You would have to ask them what they want you to do with it. Once they give you "disposition" instructions you can offer to buy it for whateveryou want to offer.

Now that being said. Ifyour insurance co. is out of state. They will just tell you to keep it since they would incur more costs in even getting it to them.

Also, if they want it back, insist it goes through a FFL and they pay the "fees" that way it's no longer in your name;).

So, When I get it back, and (hopefully not) it's it bad, bad shape, I just call them up and say, "Yo, I got my gun back and it's TO' UP, son... Worth about 100 bucks" and they say, "We'll take 80 for it?"

And I just pay them, and done?

It's been a while since I dispatched and entered things into NCIC, but I know what an insurance company paid a claim on a car, they notified the PD and if the car was recovered they notified the insurance company. So may work the same with a firearm.

True but a car is a titled instrument. I firearm is not. Around here the LE's call the original complaintant to retreive the item. It's up to the person to "do the right thing" There is a 95% chance if it's recovered he will end up with it because the ins. company can't just "sell" it to anyone, it would have to be handled through proper channels, IOW they would probally want it to go through a FFL on the out side also, to cover their butts.

I hope he ends up getting it back and it's in good shape.

Good point about "titiled" items and their ownership being transferred.

Well if the insurance wanted you to pay X amount to get it back, tell them you want What you paid them on the insurance deductible back, plus any rate increases you had to pay because of it, plus interest. On something the price of a gun, and tell them how it has been de valued they might not want to do the paper work.

Aint sure but my uncles father in law had a 54 inch big screen tv that was damaged in a home flooding. It had water behind the removable screen so he removed the screen and wiped it out. It works fine and there are no problems with it. My uncle knew what was wrong with it from the start as he is an electronics guru. Well he offered the insurance company 15 bucks for it and they took it cuz it was supposedly "totaled out" (A total loss according to the insurance company). His father in law got a brand new tv and my uncle got him a 54 inch big screen for 15.00 it was a win win for everyone involved. I aint sure but I think maybe the insurance company needs to get a new claims adjuster.

Be glad someone stole ya plastic piece. Take the insurance money and get ya a real gun like a springfield xd.

Don't get me wrong, I love my Glocks but I love the feel of the XD.

Alright... Good News...

The Insurance Company sent me all the paperwork.. I sent it all back. Today, got a check for $569 in the mail for my losses.. :)

Calling G&L tomorrow to get my Blue Label Glock 23 Gen 4 Ordered!!!!
