Beale St in Memphis....am I right?

Just to stir the pot a little bit...

39-17-1311©(3) allows the The legislative body of any municipality or committee appointed by the body to regulate public recreational property may exempt public recreational property located within its jurisdiction from the requirements of subdivision ©(1). ©(1) is the part about having to post signs.

I do agree with Razorback though in that in my opinion 39-17-1311 does not apply to handguns, but rather a list of prohibited weapons in 39-17-1302(a). But there are a few AG opinions that disagree with us.

But I do also feel that a city can block off a street, parking lot or any other city property and deem it "recreational property" for a time frame of it's choosing.

Also...if you feel you can carry concealed legally you should be able to carry open and defend your posistion to carry period. Unless you are carrying concealed in an attempt to "get away" with something that you aren't sure is legal.

Actually, I think that open carry on Beale Street would be legally defensible. I think the city is enforcing laws they are not permitted to make under Tennessee Code.

If I ever win the lottery, I might have the money to challenge it. This is the kind of thing publicized and fought by gun rights groups in other states.

Meantime, I'm glad I live about as far away from Memphis as I can and still be in Tennessee.

but as you enter, they check ID, then have you lift your shirt to expose your belt...then you move on...lol

they do the same "check" at the FedEx Forum

I have only been to beale twice in 4 yrs...I dont go unless there is a REALLY good reason...I stay away from downtown.

Is that all? I am heading down their next month to go to a Tiger BBall game, I will have to park in downtown, walk across Beale Street, and into the FredEx Forum.

I was downtown for work today so I drove by Beale Street today, around lunch, they had Beale Blocked off with the normal saw horse barriers with the cross streets open to car traffic. You could not drive down Beale. Don't know why, there was nothing their to indicate some event was taking place.

That is all they did when I went to a Tigers BBall game...but dont hold me to that, I have only been there once...and I cant remember if they have metal detectors, but I am almost sure they do not...they do not pat you down, I can tell you that.

on a side note, thee is parking structures closer to the forum, but you gotta pay...

it is blocked every time I have been near beale, I dont think they open it anymore. but I am not sure...

in a different light...

People go to Beale street to party, bar hop, and things of this nature...

Loitering is prohibited so its not like you can just "hangout" so even if you COULD get on to Beale with a Glock wide open on your side, and your pitbull off its leash...:eek:

then what are you gonna do? you cant go IN any of the bars...its kida like hanging out in the parking lot of a night club...WHY????
