Lets talk hypothetical situation's at POSTED parks

Just wondering,

City Park that is posted.

1.

Can you have an pistol with you in your car/truck if pistol/ammo is in a separated, just like a non permit person has to transport a pistol ?

a. Maybe you had car trouble and had to pull off the road, noticed you are in a posted location, separate your gun and ammo in the same way you would as if you noticed you forgot your permit at home.

2. Say I am driving though Oak Ridge, not intending to stop at a Posted park but for what every reason I am being pulled over by a LEO because maybe speeding. Lets say the only good safe place to pull over is a posted park. Could they try to get you for Carrying in a posted location because they pulled you over?

There are AG opinions on both of these.

On question 1 in Opinion 09-129 the AG has said a HCP holder could leave their firearm in their car while at a park being used by a school. (See footnote 2 on page 3). However there are exceptions in 39-17-1311 if a park is off-limits and leaving it in your unattended vehicle is not listed, so there is a bit of conflict there. But IMO if it leaving it in your car is good enough while a school is using a non-posted park it should be good enough while in a posted park. However...why is anyone going to search your vehicle anyway?

On question 2 see Opinion 09-158 Question 7. The short answer is No.

I think if I am getting stopped near one of the parks in Oak Ridge I will just slow down and try to find another spot to stop, as I read number 7. On the public road beside ok, but if I were to turn into the park to stop it could turn into a grey area. But then again, it would be them putting you in that situation. Big grey area. I don't intend or want to be Voldemort.
