Question for you guys on here:

Me and the little lady were going out last night and I had my G23 with me, We were going to a place downtown and I took my G23 and put it in her glovebox. She proceeded to ask me: "Since this is my car and your gun, I won't get into trouble will I?" I proceeded to tell her no, because I was the one with the HCP, but, would she?

IANAL and it is just my opinion but I wouldn't think she'd get in trouble as long as either you are in the car with the gun or both of you exit the car. If you went in somewhere, she stayed in the car and you left your pistol in the glovebox (which would kind of leave her 'in possession' of the loaded firearm, although I am not sure she if she would be in a legal sense) - on the very slight, off chance that anyone would ever even know - then who knows? Personally, I think a LEO would either have to already be ticked off or would have to be in a really bad mood to want to go through the trouble in that situation. Leaving a 'spare' in her glove compartment that she drives around with while you aren't with her, though, isn't something I'd want to risk.

Things like this are part of the reasion I am glad that my wife decided to get her HCP, too. Since she is also now licensed to carry, it wouldn't matter. It also means I can hand her my BUG, etc. if we are somewhere and something just doesn't 'feel' right. Even if she never carries very often, herself, it is worth it for that.

I guess if you were really worried, you could unload the firearm and put the pistol and ammo in different locations in the vehicle since a non-HCP holder can transport a firearm that way, legally.

To be honest with no one in/at the car at the time I'm not sure if there is a 100% correct answer...

May depend on the officer. Of course if no on is around the car....why/how is anyone going to be searching through the car to find it?

Now if she was in or around the car and you weren't...there could be a problem I guess.

Leaving a gun in her car while you both go in a store or restaurant shouldn't be a problem so long as she isn't going back to the car by herself. It's really no different that you leaving a gun in your own car while you both are out.

If you were to forget and leave your gun in her car though, and she's stopped driving around with it by herself, then she's technically carrying a gun without a permit. In that case, somebody's likely going to have some explaining to do.

So...

Your gun + her car + you = Okay

Your gun + Her car - you = Trouble

That is what I told her, pretty much exactly. I just wanted to get what you guys think without me adding what I thought cause I didn't wanna get 100 "You're right/ You're wrong" responses.. :D

I think that as long as we're both there and I have my HCP and there's a gun in the car, even if it's her car.. What officer would think it was "her" gun? Really?

We don't leave a spare in her car, although I have almost talked her into a cute little revolver she's gonna keep in her nightstand because she can't take it to work, she's a teacher.

So is there a castle law in Tennessee as I thought there was and does it not extend to your vehicle? I thought as long as you could legally possess a handgun, you were allowed to carry in your car just like in your home. I need to do some research just for clarification sake.

ARRGGHHHHHHH......there is that term "Castle Doctrine/Law" again.

Long story short...No, you can not have a loaded handgun in your car unless you have HCP.

The Castle Doctrine does not mean the same thing from state to state. It is not some single law that a state adopts and then it means the same things. It is a group of laws dealing with firearms and self-defense, but can be and are slightly different from state to state.

Some states do allow you to have a loaded weapon in your car without a permit, but TN is not one of them.

Or you could do what I did when my wife and I went out with some friends on the spur of the moment. I decided I wanted to have a beer or two so I unloaded, put the gun in the glove box and the mag in the back/trunk of the car. That way it's just transporting a firearm no different than a trip to the range when you don't have an HCP. Unless the GF is not legally allowed possession of a firearm you and she are fine.

I can state near for a fact that if your gun is in her car and she is rooting around in the car or standing there with the door open that she can very well be charged with going armed. ( provided you are not right there).

She might not get convicted and a lawyer can probably get it dismissed.

If you are right there I do not see her being charged.

it is your gun, YOU be responsible for it. That means do not leave her in a position of being in the car or at it with the doors open and you not right there.

Agreed, I never left the her there with it and it in the car.. Ever. I was always right there when either of us were in the car or anything. I was just wondering because she asked me. I didn't leave it in her car or anything, because I KNOW that without me there, she would be charged with intent to go armed and stuff, but, with me there... Not so much.
