Carrying without a carry permit?

I have been through the carry permit class and have all my paperwork sent in to the TBI, but still do not have my actual carry card....long story short ever since I have taken the carry class and seen some of the urrent events involving bad guys killing the innocent(sheep) I have really had an issue with not being able to carry RIGHT NOW without my permit. In my opinion and many others it is my right as a responsible, safe, and educated citizen to carry, as the 2nd ammendment does not say the right to keep and bear arms with a carry permit.

I recently read the Sheep, Wolf, and Sheepdog speech that was written by LTC Grossman and am very aware of the fact that bad people are everywhere and that I need to be a pistol toting sheepdog with or without my carry permit....but then there is the law, what a conundrum:eek:

Hope this doesnt cause any anuerisms

Well, that's a choice everybody makes. Keep in mind that if you are caught carrying without a permit it is possible you will never be able to get one.

If, btw, you use the weapon in a justified situation my understanding is that we have a "safe harbor" provision here and you will not be charged with carrying illegally.

Also, the argument that you have a "right" under the 2A (or the Tn state constitution, which also guarantees it) has been rejected by courts here.

DO NOT be foolish and carry before receiving your permit.

Carrying without it and getting caught will cause you to be charged with possessing an illegal weapon with the intent to go armed. It is a Class A misdomeaner but with it comes being forbid from having a carry permit and being forbid from purchasing firearms. That charge is one misdomeaner that prohibits you from being a gun owner.

At best getting caught will cause you to be jailed until bail is posted and you will need an attorney to resolve the charge. If you actually are carrying you will be in a boatload of legal trouble. A Class A misdomeaner also carries the possible penalty of 11 months and 29 days of jail time.

I speak from first-hand experience. The only thing that saved me is I was not guilty of the offense and it was dismissed in court. Still it cost me a large legal bill and months of angst and grief.

Do not do this.

Although Rabbi and I don't agree on whether or not "rights" exist, it is definitely true that the state of Tennessee does not acknowledge your right to carry without a permit. If you carry without one and don't get caught, then you'll be fine. If you do get caught, it is possible that you'll be in big trouble. It's a decision you have to make on your own. I can say that if you end up in a life or death situation you will probably not regret having a gun on you, legal or not, but it is up to you to honestly assess your odds of being in a life or death situation and weigh them against the potential costs of getting caught.

If you do decide to carry illegally, you might not want to write about it on the internet. My father once told me never to put anything in writing that I wouldn't want to see on the front page of the paper. It seems like a good rule to me.

if you get caught, you get screwed...dont do it..there are other things, pepper spray, knife, other things that you can carry in the meantime, last thing you need right now is a firearm offense...

you may be able to justify it in your head, but you WILL be screwed if caught...

dammit, I think I just had an annurism...lol

seriously...it doesnt take as long as you think...you have made it this many years without carrying...another 30-40 days isnt that bad...get something in the meantime, and keep alert.

I would say it is MORE than possible.

maybe not the front page but you will be in the paper. You want this to be part of your 15 minutes?

if you get caught, you get screwed

truer words were never spoken.

Well fellas I appreciate the guidance. I have decided that it probably isnt worth the risk, but I do feel rather uneasy about knowing what I do and not carrying. I cannot carry to and from work anyway as I work on property that does not allow me to carry on its premises, but I cant say that I wont limit my trips to and from the store and to "Coke Ridge" as it seems that Oak Ridge and the surrounding areas are getting worse by the day.....

Just concerned, I took the red pill and it opened my eyes....guess I should have taken the blue.

when i applied for my permit a year ago, the clerk at the DL station told me that the paper was a temp permit until you either got the permit in the mail or a declination letter. im not sure about the actual truth to that, but i would not do it unless you have that permit. you could be risking your ability to exercise your 2nd amendment right forever.

Clerks on crack are never a good thing...they should implement random drug testing...

a temporary permit would circumvent the background check...

there is NO SUCH thing...lol....

well, yes, but the caviot to that is that your permit cannot be expired....

From the TDOS site:

http://www.tennessee.gov/safety/handgun/handgunfaqs.htm

- Renewals can be submitted up to six (6) months prior to the expiration date. Any person whose handgun carry permit expires and such person applies for a renewal within six (6) months from the date of expiration, such person shall only be required to comply with the renewal provisions. However, you may not lawfully carry a weapon until you receive a new permit.

-If the renewal application is filed six (6) months or more from the date of expiration, such person shall, for all purposes, be considered a new applicant.

-The fee is $50.00. A background check will be conducted on all renewal applicants. A new permit will be mailed from the Central Handgun Permit Office. Permit Holders may legally carry with the receipt provided from the application.

*******

The reciept is good while background is being conducted, if your permit expires during the process, you must carry BOTH the expired permit, and the reciept that shows the date.

It is a Class A misdemeanor carrying a handgun in a public place where other people around and a Class C misdemeanor if caught with the handgun say in your car. A misdemeanor offense will not keep you from being able to buy a firearm and i highly doubt after some period of time has gone by, that you can get a TN handgun carry permit. You would probably be fined and your gun taken to be auctioned or used by the police as their new gun. It is possible to plea bargain (pay a lawyer) the charge to not go on your record if you have a clean criminal record. The real pain is paying a lawyer to get that expunged if you can't plea bargain. Not the end of the world but even misdemeanor convictions can cost money and time.

It is your choice and i wouldn't slam someone as a bad person who has an otherwise clean record and badly needs to carry a handgun but doesn't have the piece of paper because a lot of states don't require paperwork to carry loaded in your car or unconcealed on your person. TN is pretty strict for a Southern state.

no, I can carry my assigned pistol and rifle, but I cant bring my personal gun on the site as it is prohibited by federal law.

on the permit note, I just talked to a buddy that said because of the holiday it may take a little longer for me to get my permit, but I should have it in two weeks or so.

Only the government could come up with such an idiotic set of laws. You can't carry weapons too work, but once you're here we'll give you weapons.
