legal or illegal

So I had to go to Columbia to a funeral today with my wife. After we left, she wanted to go to J. Alexanders in Cool Springs. They are definately not posted on the outside of the building, so we enter. After getting inside there is a small sign that is on parchment paper stating that they ban guns in their establishment, but the wording is definitely not legal. Had I been by myself, I would have walked out immediately. However, my wife did not see it and was already being escorted to the table by the hostess. While eating, I told my wife that we would not be coming back and she agreed.

Now here's the kicker, although obviously not worded correctly, there is a "Ghostbuster" sign in the background that is barely visible and would not be visible at all if the light was hitting it just right, as it was when we entered.

Is this a legal post or not? Seems like they are at least challenging to outer limits of the law.

might be arguable on the problem with that now.

But what bothers me is very discreet signage like the OP describes.

Isn't there some part of some law that says that the posting must be clearly visible?

No, it was off to the side, and only on the inside, so, if it is a legal posting, you would have been made a criminal before you would even be able to see it.

Then Not Legal has to be posted on all doors customer use.. at less what I've been told..

IIRC, J's in Cool Springs has two sets of doors--an exterior set and then another set going from the entry foyer into the main part of the restaurant. It's not posted on the exterior door...but rather on the second entrance from the foyer into the main building. Off to the right in a way that's hard to see... Up until now, I've not entered there carrying given alcohol is served and before this week it wasn't legal to do so. But I remember seeing the sign once and thinking how tough it was to see. If entering among a throng of people (not uncommon in a place as busy as J's), it would be easy to miss for sure.

Exactly, but once you get past that first set of doors, you are technically already in the restaurant since they allow people to drink in that area while waiting on a table. The hostess opened the second set of doors for my wife and the open door kept her from seeing it because the frame covered it up.

BTW, is it only the Cool Springs location that posted. I don't recall ever seeing one at the White Bridge Road or West End locations. Of course, if they are posted in a likewise manner, I may have missed it.

The points being made here as to why it is not proper are good.... as far as a 100% legal opinion, that would have to be made by a judge or jury at trial. But I bet it wouldn't ever get that far, if somehow they found out you were carrying I bet they would just tell you to leave or probably even just to disarm.

There is debate on that, but regardless, if it is not law now, it will be soon.

So I think it would be better to have made a post that addresses the issue about the sign, since it is either relevant now or will be very, very soon.

These signs are a little funny in TN....they have to be visible/easy to see and on all entrances...now that is up to what is easy to see...who knows....I'd be willing to bet 99% of all places don't have signs up on all entrances...the signs aren't easy to see...or something else if you get real nit picky...normally I don't look for signs...I may see one if it stands out big to me...those would be legal I guess...kind of catch my attention....even then I do know (if you get bored) many buildings don't have signs on all entrances (such as govt buildings and hospitals where you aren't patronizing by choice...but gotta go)...so you'd probably be in the clear...for example I've seen side doors without signs.

I conceal to avoid any problems when I have to visit someone at a hospital...or get a new license plate...and keep on walking...I don't carry a full sized handgun...don't worry about it...but that's me. If you don't do your part on concealing properly, you'll probably be asked to leave....I had my gun found out at a medical facility with a sign on one of the entrance and no big deal was made....the nurse just kept on doing her work. The average joe has no idea about gun laws...and if anything will just ask you to leave.

My doc and another one I've had to see have "No Concealed Weapons" signs.

So I've thought about doing the obvious in response. :rolleyes:

Do they 'ban' you getting killed? Do they 'ban' someone from coming in and killing you? Do they 'ban' you from choking to death on a steak? Do they 'ban' the gas oven in the kitchen from accidentally exploding? A lot can happen, an infinite number of things more than they can 'ban'. Bans may sound good, but they don't prevent ;).

At Foothills Mall in Maryville there is a tiny sign that is located just as you enter the parking lot that says no guns . Unless you are looking for it you'll never see it. As a matter of fact, in the years that I've gone there I never saw it until I got my permit.

At the exterior entrance to the mall lobby there is a sign that says no guns. But at the exterior Sears entrance there is NO sigh. This is the entrance I always use.

Can I carry at this mall legally?

The signs have a firearm with a circle and a slash. I'm pretty sure they are the required signs designated by Tennessee law. My question is about the placement of the signs.

All entrances to the mall do NOT have these signs.

the same argument can be made for opry mills too but i won't open a can of worms. all of the other malls have them as you enter the parking lot and plainly visible but if the one in question is not then at best they could ask you to leave. i think movie theaters are the same way, you won't see it unless you're really looking.
