If he wasn't in fact speeding, then there has to be some other reason for the officer to pull him over.

Yep, like maybe that cop was needing to charge someone with a crime to meet a quota.

If there was no other reason, then I would be able to see where he could file complaints of lawsuits against the officer. His admission of guilt to breaking the law (even if it was only in order to speed things up) should cancel out any chance of filing a lawsuit or even a complaint.

Disagree, fighting it would have been expensive and taken a lot time. It's cheaper just to take the plea and roll out. I know, I have been there. I pled down on a bogus and trumped up charge because of a couple of dirty cops. After 10,000 dollars and three months fighting it, I was tapped out. The only thing good that came from the situation was the expungement. This guys case is just another reason we need serious overhual of our LE and judicial systems.

Moreover, shouldn't the TBI or Feds being investigating this to determine if punishment or disciplinary action has been held over the heads of the officers for not making the quota?

I was overly nervous for no reason. Had he given me a field sobriety test, I doubt I could have passed it even though I wasn't under the influence of anything, and it could have been me in this guy's situation. Personally I would have considered that to be my own fault for my behavior at the time though, and would have seen no reason to fault the officer for taking me to jail.

I am amazed at that response. If you had not been drinking, or using illegal drugs, or prescription drugs when you should not have, and were simply nervous over being in the presence of a LEO? And you think that is reason to run you in??

I would not have given the man with the switchblade any lip. I am not in the OP's position of possibly loosing my ability to go on with my intended Military career, so my end action would have been much different. (I have the four months to work with the system, granted) I would have gone for the blood test, and then we would have found out just how much further we had to go to get this spurious situation corrected. The OP was on the horns of a dilemma, the horns I would have been dealing with would have been of the locked style.

Had speeding been on the original paperwork filed by the officer, that would be one thing, but is was not posted that it was, and how one gets from DUI to speeding is a curious occurrence.

I have seen a similar situation, where a bad stop was turned to a speeding rap when it was not so. It appears THIS situation was one of revenue collection, not Public Safety, as was my earlier involvement of a similar nature.

I do not believe that the majority of LE operates like this, and believe it is top driven. This should be chased all the way up the tree.

Honestly, what's the legal aspect of pulling him and booking him for a "suspected-DUI" and then "changing" the charge to speeding? Honestly, can that happen?

Yes, leading the officer to believe that I'm under the influence by my actions is definately a reason for him to run me in. From there I can only hope that the officer's training will let him know that I'm only nervous and not under the influence, but either way if he is lead to believe that I am, then doing his job of protecting and serving means he should get me off the streets until it is proven that I'm not under the influence.

I do agree that THIS situation appears to be one of revenue collection, but at the same time since the one arrested chose to plead guilty in order to speed up the process then the subject should be dropped from there. If he wanted to take it any further, then as you mention he should have opted to spend more time on it and not plead guilty to breaking any laws at all.

when I was younger I used to get pulled over alot. heck my 66 dart couldn't even keep up with a 3 cyl 1.0 liter geo metro after the trans went to 2 gear. I had been pulled over quite a few times. it is kinda embarrassing and give some a negative impression. but they never had anything to charge me with.

where my wife works if you get arrested you lose your job regardless if you are not proven guilty in court.

not taking sides just some things to think about
