and ask for forms for filing for custody.

so I just went and tried to do this. The vry nice lady who assisted me said there is no such form in TN for a mother to file for custody. She told me that in TN the mother has custody, it is understood she does.

No sir it is not. In Tn, unless something very drastic has changed that I'm not aware of, custody is assumed to be joint unless there has been some paperwork filed, or a court ruling on the matter. Judges do not like giving custody to an individual parent unless they just have to.

thats what I thought, but according to what I was told the mother has custody unless the father contests it. Maybe I am not writing it clearly. I guess if the father contests it a judge may set joint custody or whatever. I dunno.

Gonna need a lawyer it seems. Still waiting on a call back.

Mike, from 2001 to about 2006 or 2007, the wife and I went through nearly $100,000 and 4 attorneys to deal with this very issue.

Granted, part of our trouble stemmed from having the matter transferred to Tn from Ky, but even once that was accomplished, it took a while for the judge to figure out the wife's ex was an idiot, and only wanted to get out of any possible responsibility - along with causing the maximum amount of trouble - for things to start going our way.

( I should add that my wife got custody of the kid in the original divorce. That was in Kentucky. The Tn judge wanted to un-do that and re-visit the whole issue. )

I'd PM you all the details, but I doubt you wanna hear the whole story. It'd only depress you anyway. :(
