Presidential Proclamation

DEATH OF DOROTHY HEIGHT

BY THE PRESIDENT OF THE UNITED STATES OF AMERICA

As a mark of respect for the memory of Dorothy Height, I hereby order, by

the authority vested in me by the Constitution and the laws of the United

States of America, that, on the day of her interment, the flag of the United

States shall be flown at half-staff at the White House and upon all public

buildings and grounds, at all military posts and naval stations, and on all

naval vessels of the Federal Government in the District of Columbia and

throughout the United States and its Territories and possessions until

sunset on such day. I further direct that the flag shall be flown at

half-staff for the same period at all United States embassies, legations,

consular offices, and other facilities abroad, including all military

facilities and naval vessels and stations. IN WITNESS WHEREOF, I have

hereunto set my hand this twenty-sixth day of April, in the year of our Lord

two thousand ten, and of the Independence of the United States of America

Now I have no clue who DOROTHY HEIGHT is so I googled her and came up with this on Wiki.

then I looked up the law.

The U.S. Code, Title 4, Chapter 1, Section 175

(m) The flag, when flown at half-staff, should be first hoisted

to the peak for an instant and then lowered to the half-staff

position. The flag should be again raised to the peak before it is

lowered for the day. On Memorial Day the flag should be displayed

at half-staff until noon only, then raised to the top of the staff.

By order of the President, the flag shall be flown at half-staff

upon the death of principal figures of the United States Government

and the Governor of a State, territory, or possession, as a mark of

respect to their memory. In the event of the death of other

officials or foreign dignitaries, the flag is to be displayed at

half-staff according to Presidential instructions or orders, or in

accordance with recognized customs or practices not inconsistent

with law. In the event of the death of a present or former official

of the government of any State, territory, or possession of the

United States or the death of a member of the Armed Forces from any

State, territory, or possession who dies while serving on active

duty, the Governor of that State, territory, or possession may

proclaim that the National flag shall be flown at half-staff, and

the same authority is provided to the Mayor of the District of

Columbia with respect to present or former officials of the

District of Columbia and members of the Armed Forces from the

District of Columbia. When the Governor of a State, territory, or

possession, or the Mayor of the District of Columbia, issues a

proclamation under the preceding sentence that the National flag be

flown at half-staff in that State, territory, or possession or in

the District of Columbia because of the death of a member of the

Armed Forces, the National flag flown at any Federal installation

or facility in the area covered by that proclamation shall be flown

at half-staff consistent with that proclamation. The flag shall be

flown at half-staff 30 days from the death of the President or a

former President; 10 days from the day of death of the Vice

President, the Chief Justice or a retired Chief Justice of the

United States, or the Speaker of the House of Representatives; from

the day of death until interment of an Associate Justice of the

Supreme Court, a Secretary of an executive or military department,

a former Vice President, or the Governor of a State, territory, or

possession; and on the day of death and the following day for a

Member of Congress. The flag shall be flown at half-staff on Peace

Officers Memorial Day, unless that day is also Armed Forces Day. As

used in this subsection -

From what I can find she was not an official of the US government at all. Therefore under USC BHO does not have the authority to issue this order and it is illegal according to the law. Once again our great leader has chosen to ignore and create his own law where none exists or where he does not like the law that is in place.

Flying colors at half staff is a symbol of respect to the members of out military and to key figures in out govt, she was neither. With all do respect to her and to he family she may have made great strides in the civil rights movement but she does not warrent this honor under the law of the United States.

What we have here is a blatent disreguard to the law by POTUS. If you work in a goverenment building and the flag is at half staff then you need to correct your supervisor and bring this illegal order to his/her attention.

I am so glad to know that you give such a **** about the law. If the laws of our country do not apply to every single person in out country then who do they apply to? If POTUS does not have to follow the law then why should the rest of us.

Actually he doesn't, but...

He is ordering the people included in that statement to do so, so I would take that to mean that they have to. Just throwing that out there, as even though I do not agree with Obama's act of breaking the laws in this case I'm currently not wearing underwear that could get in a wad over this one.:bat:

I'm not about to stomp on you, bk, but the same sentiment was offered only days ago when Zero made a call out to his following, which was almost everybody except "the man." Not a huge deal in and of itself, but all these little things are building up to nothing good.

Obama is a lawyer. Recon he may have gotten a ruling on this before he did it? If it's blatantly illegal, then I'm sure some good Republicans will slap him down for it. My guess though is it just more bull :P.

Get over yourself buddy. We've got bigger fish to fry than the president ordering a flag to be at half staff for one day. :P It's frightening for me to think that there are folks like you who are just now realizing that there are people out there that act above the law and get away with it. Scary isn't it?

I think we need a zero tolerance policy with regard to the government at this point. Call them on everything, no matter how relatively insignificant.:D

PS- This is not intended to be sarcastic, I'm serious.

This conversation is about Zero, not Dubya.

Not defending BHO here, but if he was a Zero, there wouldn't be so many conservatives screaming bloody murder right now.

Dubya is relevant in one way. He consolidated executive power, stomped on the constitution, grew government, and spent money like a drunk sailor. Maybe even moreso than BHO. There was plenty of pissin', moanin' and finger pointing from the left, but the right seemed to be perfectly happy.

The major difference is that one was a conservative, and one is a liberal. Pissing and moaning about things that were perfectly acceptable in the last administration, and are all of a sudden anti-american now does not help the cause. Conservatives can't win back the people they lost until they regain their image of being sensible folks.
