Scenario:

A known vicious dog digs under and enters your fenced yard.

Variables:

A family member or yourself is in the yard

Only your dog is in your yard

You view the dog from your window and no dog or person is in your yard

Dog is small, but powerful (maybe english bulldog)

Dog is large (over 90 pounds)

Dog has a pistol and body armor:p

umm ok..I will play

Assuming that the neighbors vicious dog got into my backyard, and my dog wasnt out there, and no people were out there, I would go tell my neighbor to get his dog or I will shoot it :) kidding...but I would just tell him to get his dog.

If my dog was out there, I feel sorry for my neighbors dog.

if my kids were out there, I would shoot his dog if it went after my kids, otherwise, I would get my kids in the house and go see the neighbor.

if I was out there, I would be playing with my dog while I smoked, so once again, I feel sorry for the neighbors dog. Here is Larry:

I'll chime in . . .

My niece and I are in the yard: Protect my niece, by any means necessary.

My dog is in the yard: The neighbor's dog will leave of its' own accord.

Nothing in my yard: Leave by the front door, go speak to the neighbor, tell him if it happens again I will be bringing his dog with me when I return.

Dog is small but powerful: If my dog is in the yard, tell my neighbor to come get what's left of his formerly powerful dog.

Dog has a pistol and body armor: Give my dog a rifle to even the odds.

I love dogs. I rescue dogs.I think Michael Vick should have been given life with Bubba.

Now....

If it's a dog I think is "vicious" and it's in my yard - it's a dead dog.

Tennessee code makes it illegal for you to let your uncontrolled dog get off of your property. I'd shoot the dog and then make it's owner pay for having someone drag it back to their yard.

Simplest answers I can come up with:

Dog in my yard, no one else: Go yell at dog, if that doesn't work fire 1 round into ground in front of dog (that works unless it's in "attack mode" already).

Dog in my yard, me or anyone else in my yard. Dead dog, dumpster material.

I say this because 1 all my neighbors that have dogs either keep them up (mostly shepherds) or the other bunch breeds pits and they let them run where they will. I can step outside and if the oldest pit in the neighborhood is out he make a bee line for his yard and stays there.

No one in my yard? Dog will go away. If he is vicious and has been known to attack people? Dog is dead.

Kids or anyone else in the yard? Dog is dead.

Dog has body armor? Talking to owner to see where he got it...

Good takes on this.

My initial feeling is:

No one in my yard--call the cops and pound

Persons animals my yard--draw weapon and try to get everyone inside without firing. Fire if dog gets within +/- 10yards of a possible victim

Dog has armed and wearing body armour--head shot. then box it up and send it back to fitty cent.

Here's another variable:

Choice of weapon. Your options are AR15, .45 1911 or 12 gauge pump with 00

Target: Assuming it's facing you. Head or chest or both?

ps I love dogs and would hate to ever shoot one

hah! its a doggie chew toy.

thats why you offer them your weak arm to bite on..meanwhile the strong arm is armed and blowing their stomach out through their spine.

I don't know if I could successfully do that..but I would have to try it.

as for the dog in the yard...

That dogs' life hinges on only ONE thing. is that dog a nice dog or does he growl at people.

if he growls at strangers then he's a dead dog, I don't care if I have to dispatch him with an axe. I don't care how big he is, I don't care how small he is.

many people tend to forget that dogs used in official (read police and military) capacity are weapons. why? well..because they're so effective!

they don't call them Canidae for nothing...they're all descended from wolves.

They all are hardwired to kill prey. If that dog is sufficiently friendly enough to associate only a food bowl as prey, hes a safe dog and I'll walk him home myself and inform my neighbor that his dog got out.

If he's mean or shows ANY sort of threat to my family? well..I'll call the neighbor and tell him to either come get the body or I'll have to call the police and file a report to have it removed.

waaay back in my military days, they taught us that the best way to make a dog ineffective was to kill the handler. (that was during E&E training)...the idea being that the dog listens to commands only from his trainer.

if I were inclined to inhibit the use of a dog, I would do just that, but before he sicced the dog on me.

after the 3rd scare only shot i have never had a dog come back in my yard. never had one come in my yard and growl. that wouldnt be a scare shot. now stray cats are another story i wont go there except to say they wont learn.

Are you sure that is a STATE law, or a local or city code?

I doubt the law allows you to shoot any animal because it wanders onto your property. Unless you could prove an unavoidable threat, you'd likely get sued.

It's a state law. It applies everywhere in Tennessee.

If someone's dog wanders onto your property, or onto public property.like a road, the owner is in violation of state code and has committed a crime.

As I recall, there are some provisions for allowing your dog to roam during a hunt, but not just to roam because you don't want to keep your dog under control.

It is a state law that you are supposed to keep your dog under control.

T.C.A. 44-8-408

I can't find anything that says it is "open season" on at-large dog however. T.C.A. 39-14-205 says you can kill an animal if the animal was creating an imminent danger of death or serious bodily injury to you or another or an imminent danger of death to an animal you own.

There is one type of dog that can be shot on sight. A female in heat, running at large.

T.C.A. 44-8-411
