Restaurant Carry Bill

The ramification of this clusterphuck will haunt us for a long time. Unless the House gets the Senate to adopt their version of the bill, at this point i'd rather they pass nothing.

Currently, according to our worthless AG Cooper's opinion, a circle/ slash on it's own is meaningless. The Senate amendment would give just the circle/ slash the same authority as a full blown legal language sign. Screw that.

This is exactly how I feel. I am to the point where I rather not get anything passed than a flawed bill that gives us just a little something (which, I believe has a great chance of getting struck down again due to the 50% rule that's based on something already illegal) but takes away a lot. There is far too much that can go wrong with those little signs that could land a law abiding citizen in big doo doo. We now need to push hard for them to pass the other bill or remove the amendments (adopt the house bill I believe.) Let them know that we will not stand for this crap. Trust us entirely (AKA: stop treating us like criminals) or give rid of permits entirely and see how that works for crime.

I am sick of these games and people with no back bone.

Had HB3125 been introduced in the form it was after the first amendment (what passed in the Judiciary committee) it would have never gone to FW&M and had all of this.

I admit, at this point I would rather see HB2694 (as it is now pass) or nothing. Assuming if HB3125 can't be fixed on the floor.

Not even sure if I want the appeal of the current law to win...as it might just be an excuse not to do anything in the future.

I just wrote my State Rep and asked him NOT to vote for HB 3125 as long as it includes the Senate's amendment. I'd rather have no bill.

There's not really anything for restaurants or "bars" to like either.

Same old argument there, they don't want to have to post and alienate part of clientele, they simply want it to stay illegal.

Another take I hadn't thought of was on Knox local news tonight, didn't catch which one...was a club owner who will HAVE to post under the new 50% rule.

He wasn't griping because of pro carry but because it would give impression that his place had had shooting trouble or something, which is why it's posted. Didn't want any possible stigma by posting sign, but he'll have to.

I just wrote my State Rep and asked him NOT to vote for HB 3125 as long as it includes the Senate's amendment. I'd rather have no bill.

Mine, Joe Armstrong, votes against ANY bill that increases freedom of carry, so in an odd way I guess this will be the first time we agree on his vote, although for different reasons.

I hope the ABC visits EVERY bar that posts and checks their sales records. There's probably enough fines out there to fix the state budget. :D

TN ABC is obviously corrupt as hell, and I wouldn't at all be surprised to find that there are a lot of "unrecorded fines" in addition to the acknowledged monthly ones that I just read about for the first time.

I am very troubled by the amendment attached to SB3012 / HB3125. I feel that this legislation is important, but I would rather have NO carry where alcohol is served- as it is now, than to lose carry in many places currently utilizing the circle/slash only. Are you opined as to the possibility of the amendment being removed when brought to the floor for a vote or some similar action being planned by TRUE 2A supportive lawmakers? It appeared when the bill was introduced that it might be good legislation, but I was extremely disappointed when some of the supposedly more pro 2nd amendment senators supported and voted for an amendment that in actuality, could REDUCE our rights as HCP holders. (In my honest opinion, if Nafieh can comment positively, on a piece of gun legislation, then we the honest HCP holder must be in trouble)

C) A building, property or a portion of a building or

property, shall be considered properly posted in accordance with

this section if one (1) or both of the following is displayed in

prominent locations, including all entrances primarily used by

persons entering the property, building, or portion of the property

or building where weapon possession is prohibited:

(i) The international circle and slash symbolizing

the prohibition of the item within the circle; or

(ii) The posting sign described in this subdivision

Please tell me that I am somehow misunderstanding the current legislation, or that it is part of a larger plan and the amendment will be removed this from the bill and it will EXPAND the law abiding citizens right to self defense.

Your insight on this matter would be greatly appreciated.

ALL do the same. We have a voice. Make it heard. Call and write your lawmakers, and let them know we are watching, and are not pleased with the way they are handling things. No point in bit**in' here but then not aiming your grievences at those who have the ability to fix things.

Here's what I sent...

Dear Rep. xxx,

If the Senate's amendment to HB 3125 stays in the final version of the bill presented to the House for passage, as strange as this seems, I'm going to ask you to please vote against the bill.

Here's my thinking on this...

This second amendment, added by the Senate, was pretty much done at the behest of Randy Rayburn. He said that if the signing law was changed, he probably wouldn't file suit again. He doesn't want a clear, visible sign that states the law etc. He wants a sign no larger than 4" x 4", basically just a circle/slash sign he can post as innocuously as possible. The Senate amendment, strikes the mandatory language, takes us back to the "substantially similar" standard, which basically means every establishment can pretty much write up whatever sign they want. It also makes the circle/ slash sign alone, without verbiage as legally binding as a full blown sign. The problem here is that the state's AG has issued an opinion in the past that said the circle/slash sign on it's own without the "substantially similar" language had no force of law. And the signage law change won't just apply to restaurants, but everywhere. This will cause confusion by longtime HCP holders.

Because the amendment would apply to all HCP posting signage, therein lies the rub. Many places that haven't posted because they don't want to deal with a large sign and it's obvious message may be a lot more amenable to just allowing a little innocuous circle/slash sign to go up along side the little "no smoking" circle/slash sign on the door. And you can be sure the TN Hospitality Assn. will be handing them out in droves. HCP holders may very well end up with far more places off limits to carry than we have now, with all the signage having legal ramifications.

To be honest, I'd rather have no bill than this one, with the Senate's amendment included.

Additionally, I'm going to ask you again to support HB 2694. It's a clean bill that simply removes the violation of carrying in an establishment that serves alcohol as long as you have a HCP permit and aren't drinking.

Dead on there OhShoot, they have not done a "Food Audit" in about seven years. I have a contact inside, they have been instructed to not inspect. One must realize, that they ABC works at the "Pleasure" of the Governor only, they have no duty to any other entity, other than the "Hospitality Lobby".

Bredesen took the money from the NRA, stood flat footed and promised to sign any "Restaurant Bill" that hit his desk, if we could get it there.

ABC does not count beer as an alcoholic beverage in their reconnoitering, the deck is stacked against the HCP holder.

Our Legislators are sticking it to us, they think the average Citizen will be fine with them taking a little of our Constitutional Rights at the time, they see the Federal Government getting by with it, so they think we will simply sit idle and allow this.

We must prove them wrong or we are lost!

Is the ABC hard on giving out liquor store licenses in TN? Just curious how 'corrupt' it is here when it comes to the ABC board. Back home...the ABC board only gives out X number of liquor store (the liquor stores in Arkansas can sell beer, wine, liquor, candy, ice, cokes, etc) per wet county. Unless you are in a county with growing population like Washington County, Fayetteville/Springdale, AR, there are really no new liquor store licenses. So, if you want a liquor store...you have to pay a CRAZY amount of money to 'buy' a liquor license from someone.

Restaurants and bars have it easier to get liquor licenses from the ABC. People still go and petition to try to stop them from selling but those licenses usually go through. Gas stations and grocery stores don't have problems either to get a license to sell beer and wine.

The process for all of it is so bad though that I'm sure some people have to hire a lawyer to get it all taken care of properly and push the paperwork through and how to handle the ABC board in Arkansas.

So, really we need to focus our efforts on getting the Senate to drop amendment SA1236 from their version of the bill. That is the one that allows EITHER a TCA sign OR the circle/slash. if the House bill gets passed first, possibly the Senate could do like they did last year and just adopt the house version and vote on it. The house version isn't perfect either, but at least it is better than the Senate version with this sill circle/slash nonsense.

In the house version, the circle/slash can be posted WITH the TCA wording, but not by itself. Right?

I just want to make sure my info is correct and my arguments are directed at the right group of people when I start contacting representatives to share my opinion.

Whachoo talking 'bout, Willis? The "BEST" option is HB 2694. That's the one we need to support, not this HB 3125 POS.

I agree as of now the better bill period is HB2694
