How can the healthcare bill be legal as it raises revenues and was started in the senate?

Article I Section VII of the Constitution.

All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

So how can this pass the Constitutional test?

I believe the bill started in the House. After the House passed it, the Senate then modified it as they saw fit - and passed it. The House then sat on the thing for months while deciding what to do. They had to either pass it as the Senate passed it or go to a conference committee to iron out the differences. The problem was that the Senate wouldn't do the ironing - they didn't have the votes anymore due to Brown being elected in Mass.

The only way to get it through was to pass it as is. Then they started a new bill to "correct" the Senate version. The Senate can then use reconciliation to pass the update with only 51 votes instead of 60.

Whew! I think all of that is correct -- but I am not a lawyer so there is no way I can understand all of the shenanigans going on in congress.

You are correct, bubbadavis, but that's the politics. The bill that passed usurped the

constitution, and the states' right to self govern, and the peoples' right to choose what's in their best interest. Otherwise known as the 10th Amendment and it is going to be challenged by a lot of states in the federal court system. It also violated congressional authority to pass a law set forth in the constitution(don't remember the article and section). Judge Andrew Napolitano has written a couple of books about this and would be a good reference if you wish to look further.

redbarron06: It can't pass muster without force and that is what it is all about.

Glenn: They may not care, but it is our right and duty to defend our freedom, isn't it?

That Constitution was written for all our benefit, not just a few. You can't make someone care, but you can educate, and you can defend your liberty by sending them away. Tyranny must be fought. Don't let this just be a sour belly. It is time to fight back.

this is the Senate bill. It was SB###. As far as the recn bill it will have to be passed with 2/3 because it effects Social Security funds. Rules of the Senate require it to go to a full vote so 50+1 dont count.
