I'd like to know what is in the Amendment before I support it...I'd like to read. If it does away totally with the stupid $500 fine and seizure of my handgun in this state from 'properly worded' signs I'd be very inclined to support it.

For a variety of reasons I was unable to make it to Nashville today, but do intend to try and watch the sub-committee meeting via streaming video on the state's website.

It starts at 11:00am (CST) or in about 15 minutes.

I will post about any restaurant carry bills in this thread, and other firearms bills in the thread below.

Looks like HB3125 is the last item on the calendar. It could be a long day before they get to it - and I suppose it is always possible that they run out of time and roll it to a different day.

Boom, they changed it. HB3125 got moved to the top, they are discussing it now.

No set time.

It may be on the full committee's calendar next week, but doesn't have to be.

I think the though if/when it passes the full committee, it will be ready to go to the floor, but the calendar committee will choose when that is.

But then there is still the Senate version that has to move, although they will probably wait until it passes the house and just substitute the house bill for theirs.

What did the amended version of this change? The video messed up on my computer and it looks like I'm having problems pulling up the legislature's website. Thanks.

The hospitality guy mentioned it would allow carry in ALL places that serve alcohol, including those that only serve beer.

Also the part about exacting wording for 39-17-1359 is still there and it was mentioned that ALL entrances would have to be posted, even if a place had "hundreds" like Opryland hotel.

It does look like they want to make it automatic revocation of your HCP and/or increase the penalty (jail/fine) for consuming while armed in any of the places. But sounds like they will address that in the full committee

So does this mean by at most a $500 fine only for violating this 'proper sign', that I would not lose my gun, and I would not have to worry about my permit being suspended? This is not ideal, because I would like to see the penalty drastically reduced, but it is in the right direction.

As I don't drink while carrying, anyway, neither do I - especially if the trade-off is that a law-abiding HCP holder in the parking lot doesn't become a criminal simply by stepping across the threshold of a place that serves booze when that HCP holder is there to eat not imbibe. That is, as long as the useless 'carry where liquor is served but not where only beer is served' nonsense goes away.

The penalty for violation of 39-17-1359 remains the same, a $500 fine. I don't think you'll see for a long time it not being a criminal penalty of some sort.

The increased penalty and revocation I was talking about was attached to a violation of 39-17-1305 in the bill. Right now being armed and under the influence is a misdemeanor. It sounds like they want to make it a felony. Also as you may or may not know conviction of a Class A misdemeanor only suspends your HCP for the term of the sentence. It sounds as if they want to make it where it would be revoked...which of course if a violation becomes a felony it would automatically do.

Right now?

Depends on where the sign is.

- In normal business, only the fine is specified.

- If in booze serving establishment, sign or not, it's a Class A misdemeanor, and you lose your HCP for duration of sentence (probation is part of sentence) and have to apply to get it back.

- publicly posted park: Also Class A Misdemeanor, so loss of HCP if convicted.

Then there's always the danger of having HCP suspended if one

"Poses a material likelihood of risk of harm to the public"

if you found yourself facing a prosecutor/judge with a stiff one on against you.
