Ok, Legal question about vicous dogs

The police aren't going to mess with someone legally shooting a mean dog on his own property. I've never heard of someone dealing with the legal system over a vicious dog in Arkansas or the Memphis area. I've heard of plenty of strays getting shot back in Arkansas in the country to protect livestock and nothing is ever said. That's just the way it is. A dog, especially a stray, is no different than any other animal.

Had one of these problems years ago when i was a young man (..a long time ago; over 40 years...didnt care what people thought, sick and tired of being "sick and tired", ect. ...). Shot a dog after talking to a life-long neighbor about keeping it up. Started a feud what went on for years.

Moral of this story: This aint a dog protection thing its a "neighbor thing"; especially if you live in a rural or small town area.

My advice: Talk to your neighbor and talk to him straight. Dont abuse him; simply tell him you are concerned about the dogs being dangerous to you and others. Ask him to make sure the kennel keeps them in.

You always have the right to defend yourself on your own property. That being said; where i come from, shooting a dog is right up there with shooting a person (...and i aint an animal rights advocate...). I noticed from your avatar you are from Fayetville. My guess is that people there hold dogs in high regard. It could be high enough to cause a serious reprisal for killing a dog that doesnt include the law. I aint trying to scare ya; im asking you to think deeply about what could happen.

That is some good advice. Some people ... their elevator doesn't reach the top floor. There are times where there is nobody at your house. Your pets can be fed poison when you are not looking. Things may get broken or missing or worse.

Neighbors can be good ... neighbors can feud.

You got to live there ... you want to be comfortable or keep looking over your shoulder?

Ok, i have all i need. Some good, some bad, and some downright rediculous.

I only wanted to know if i had the right to do what is necessary to eliminate a threat on my own property. If i could ever talk to the owners when they are at home i would, but we all are on different schedules( and since they have kids and I'm busy with my other things going on, free weekends have been hard to come by).

Next time when i see my neighbors, i will talk to them in a neighborly manner, telling my concerns about their dogs running loose, and if something was to happen they could be held liable for damages or worse.

My brother is a Lawyer so if i ever need one, I'm covered. Brother lives out of state( he can't know every law in TN), but he has friends here.

As of lately the Pit-bull has been on a leash and penned up( i have not seen him running loose since). Problem about solved.

You wanted to know if you could take care of a threat on your property? Shoot you can do that against humans anywhere you have a legal right to be, let alone an animal on your property.

...and your brother is a lawyer, but you come to the internet for legal advice?

True my brother is a lawyer, but an out of state ( Georgia), democrat, gun-hating, liberal.

I don't need any more advice, or remarks on this.

It is done, thanks you all, for the advice, some will be used, some wont.

No more advice, just an experience

My wife came home for lunch one day and let her cat out on the back raised deck where the cat never leaves the deck, very timid

Wife hears cat screaming, wife runs out on the deck, finds pit bull ripping cat apart, she looses it and charges the dog(no weapon):up:

She manages to get the cat out of dogs mouth, and chases dog through the yard, ( adrenalin rush) ps: she is scared of big dogs ( attacked when very young, bad facial damage)

the pit stops running at the property line and starts to come back at her,

she screams at it and managed to run it off:tinfoil:

Cat had major stomach damage, vet saved cat but $$$$$$

Police told me if it ever came back, put it to sleep

Police gave repeat offender (owner) a ticket and a warning

Wife now legally packs, future attacks will be fatal for dogs:p

The law is TCA 44-8-408. Sorry it took a few days to get back to the board.

I agree there is no such thing as a bad dog.....only bad owner...(I think mr myaghi said something like that.

That goes along with "Guns don't kill people, people kill people". I still won't tolerate a gun being pointed at me. I'll apologize to the gun after the owner is down. If the dog appears ready to attack (on my property) I am not going to discourse with the owner about his personality and try to pet the dog!
