A little confused

Our local walgreens recently started selling beer.While I don't drink,I noticed a hand typed and printed of the compter piece of paper taped by the beer,it read something like, "Its a misdemeanor offense to carry a handgun where beer/alcohol is sold" last I checked I thought you was perfectly legal to carry where it is sold as long as its not available for onsight consumption? Am I wrong?? I have always carried in there and no one has ever said anything and they have no other signs prohibiting carrying anywhere in the store nor outside..

It is still illegal to carry a weapon where alcohol is sold or served, however Handgun carry permit holders are exempted from that statue as long as the alcohol is not sold for "on-site" consumption. Is that just about as clear as mud? LOL seriously if you still don't understand I will explain further but I am sure someone else will as well. ;)

If you would have read my post all the way through you would have known that i knew it was illegal to carry in establishments that sell alcohol for on sight consumption..What I was asking was with all the flip flopping of the carry laws,did someone make it illegal to carry where alcohol in general is being sold!

No.

You might prompt him to put up a statute compliant no carry notice on front door.

But any business can post to ban carry in general.

But not because they sell booze to go.

If you would have read my post all the way through you would have known that i knew it was illegal to carry in establishments that sell alcohol for on sight consumption..What I was asking was with all the flip flopping of the carry laws,did someone make it illegal to carry where alcohol in general is being sold!

Whoa simmer down there 3 post. No the law is still the same as it was. You can carry in a liquor store, grocery store, gas station,etc unless it is a properly posted location with the No Guns circle slash sign and the statute text.

#_2 I am an assistant manager with Walgreens and I am very curious as to where this store is that has been posted. While we do have policies concerning firearms and employees and security, we have no prohibitions or even concern for customers that legally carry. I have had several conversations with some folks who OC in in my store in midtown Memphis ( I gave them smile and a :death: on OC in my store).

Please let me know the location of your local store so that I may look into this as I find it very disconcerting.

I thought that the law was only the text from the statute that was substantially similar to the actual text was required and the No Guns circle slash sign meant nothing at all legally.

Yes, it is legal to carry where package alcohol is served.

But....as of today a sign is still a required by 57-3-204(e)(1)

Each holder of a license to sell at retail alcoholic beverages to patrons or customers, in sealed packages, and not for consumption on the premises, shall display in a prominent place at the location where such sales are permitted a sign, at least six inches (6") high and fourteen inches (14") wide stating

MISDEMEANOR. STATE LAW PRESCRIBES A MAXIMUM PENALTY OF ELEVEN (11) MONTHS TWENTY-NINE (29) DAYS IMPRISONMENT AND A FINE NOT TO EXCEED TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500) FOR CARRYING WEAPONS WHERE ALCOHOLIC BEVERAGES ARE SOLD OR SERVED.

The above law has never changed even after 39-17-1305 has.

There are a couple of bills in the legislature that would remove the above sign requirment.

I think the AG opinion said something about the circle slash being part of it for visibility. Not sure. I guess you could just post the text, but it does say "clearly visible at every entrance used by the public" so I guess if it was in big,bold print at about 5'10" height at every entrance you could do just text.

The AG opinon you speak of says the "Circle w/ slash" by itself does not meet the requirments of 39-17-1359. 39-17-1359 does not require the circle w/ slash but it does allow along with the wording.

What store are you at so I can make my purchases there?

I'm overnights @ Union & McLean. There are two overnight managers, the old one and the ginger one. I'm the ginger one.

I will say I did have one conversation with an OC guy that made me slightly uncomfortable. This guy wears a Walther PPK "cause it is James Bond's gun" and people give him "more respect" when he OC's. I tend to avoid that dude now.

I just hope he isn't on TGO.

Just leave it alone with the store manager. Don't ask don't tell and don't OC.

Are you carrying to prove a point or to protect yourself?

If you are carrying to prove some point then OC, get the cops called, get arrested, get a lawyer and go on Fox news.

If you are carrying to protect yourself, then do that.
