Boston Police want warrantless searches for guns

I'm afraid I just don't have a lot of sympathy for the weak and stupid, especially if their weakness and stupidity affect me.

With that kind of talk Mr. Marswolf... I'm afraid that I will have to ask

that you not be apart of our group hug. (This is in no way a reflection

on you as a person or moderator, but should be viewed more as a "tough

love" gesture.) Please don't let this affect your self-esteem in any way.

Your smart, pretty, and golly people like you.

You may want to look into a certain Buddist website. I think

I may have a PM with the link... somewhere. LOL!!

The constitution provides protection for the weak and it should be up to the strong to defend it so that it can work for all of us. As for the stupid, my daddy always told me that ignorance can be relieved through education but the only relief for stupid is a grave. If an individual is ignorant about something, educate them but if they are just plain stupid, get away from them. Cut them loose 'cause you don't want to be standing anywhere near them when Darwin catches up. Words I've lived by and the way I have taught my children.

In seriousness...

There are also instances (many in urban areas) of Grandparents raising the kids. And by that I mean 15-17 year olds. Some of them may actually feel (and have reason to be) afraid of the kids they are raising. If a grandparent call sthe cops for a search there is a good chance the kid will still be there after they leave, or after they make bail. If they are in a gang, then they have to worry about retribution form members.

But at the same time unwarrenty searches no matter how well intentioned

should never be allowed. It is too easy to rationalize your actions when you don't

have a set rule in place.

For me it would become a "Who watches the Watchers?" type of thing.

So what is the answer? Don't know. It would seem that communities need

to become more active with each other, and more defensive of their communities,

their children, and their common morals. Not sure how this would be done though.

Best way I know to get rid of your weakness is to work to get strong. No one can do that for you. Well...steroids might help.... :koolaid:

I can't feel sorry for parents who lack parenting skills. They needed to make the commitment to develop those skills before becoming parents. I certainly do have sympathy for grandparents or other people who have to take over parenting because the real parents won't or can't do their job.

But I can't see anyone suggesting unwarranted searches here. I'm not using the legal sense of "unwarranted", but the common sense. They are wanting to do voluntary searches in the rooms of kids where there is sufficient suspicion that the kid is doing something illegal, but may not have enough evidence to issue a warrant.

Would I allow them to come in voluntarily? No.

But then again I'd be searching the kid's room myself. And he wouldn't be running with the wrong people. If I had to ship him to Devil's Island to prevent that, I would.

And group hugs are not my style.

...and besides, one grenade could take us all out...

Hmmm... good point about the group hugs.

Maybe we should look into some sort of training...

I wonder if there are any classes on "Tactical Group Hugging",

or maybe "Situational Awareness Hugging".

I'm really not for "Concealed Group Hugging"... it just kinda

creeps me out... but "Open Group Hugging" has it's fair share of

problems as well. :koolaid:

IT CAN BE DONE!

A parents consent to search their home and a child's room will usually be effective against the child because the parent has the "Superior Property Interest." See Commonwealth v. Hardy

However there are many factors that can effectively void a parents consent.

1.If the child uses the room exclusively (they are the only one who enters the room i.e. mommy doesn't clean the room or come in to get dirty clothes)

2.If the child has furnished it with his or her own furniture

3.If the child pays rent to the parent

4.Has otherwise established an exception of privacy

Also parental consent may not be used in court if the child has already refused to grant such consent to the police." Constitutional rights may not be defeated by the expedient of soliciting several persons successfully until the sought-after consent is obtained." People v. Mortimer

Hope this cleared up any questions on the law!

.....one complained that cops would come up to him and ask if they could search him. He responded, no, can I search you?

 Classic.

OT, how many people would be interested in a one evening lecture on civil rights in every day life, given by a practicing attorney?

I'd come as well.
