I was slightly wrong with my original post.

TITLE 18 > PART I > CHAPTER 44 > § 921

(24) The terms "firearm silencer" and "firearm muffler" mean any

device for silencing, muffling, or diminishing the report of a

portable firearm, including any combination of parts, designed or

redesigned, and intended for use in assembling or fabricating a

firearm silencer or firearm muffler, and any part intended only for

use in such assembly or fabrication.

If the item diminishes the report at all it is a class III item. I just wouldnt **** with it.

Yes you can make your own, but if it reduces the db any it is considered a suppressor by the BATF. There are several companys that sell fake suppressors, so why not purchase from them?

OR you can join the suppressor forum and read about making your own (diagrams, etc.. Just fill out your F1 first)

So, what differentiates a fake from a real supressor?  It seem like a long flash hider might well knock off a dB or 2.

This is a VERY old post but I want to talk about it anyways.   My guess is that you won't find a clear cut answer to the question. The ATF likes it that way. When you have clear cut answers within their rulings and opinions  and all that we get something like the Sig Brace. They just love to leave gray area's open to interpretation (theirs not ours).

If anything is attached to a gun and reduces, or changes, the sound of a gun shot it must be registered as a silencer. Even if it only reduces it by one decibel it must be registered.

The very first 22 MP5SDs had a barrel shroud that looked like a fake silencer. Because it could be reversed and installed on the barrel and because it changed the sound there was a recall issued for importer to correct the issue. Anyone caught with the original shroud on their MP5SD could find themselves answering some questions

Most fake silencers are nothing more than a heavy wall tube that does not reduce the sound.
