Gun Show Carry ?

Im wondering specificaly for Memphis and Jackson if carry is ok at gun shows or if it is banned by state law or or NO-CARRY or banned by the promoter or venue ?

There is no law against it, but many gun shows require you to have your firearm's action locked open with a zip tie ... usually enforced by someone at the door. I've always assumed that was for a firearm being carried in for trade or sale. I don't expose my carry weapon so I don't let them zip tie it into a useless state.

I was reading about the cc laws the other day and there is something to think about. I am not one hundred percent sure if I read it correctly or not so no-one sue me okay. LOL

But what I read was that the same laws apply for cc rules when the gun show takes place on municipal property or managed by the municipality. So it really depends on where the gun show is held. The ones that I go to are on the old Worlds fair sight and it is run by the city. So it is my belief that I am not allowed to carry there.

I may be totally wrong and if so, I would love to be corrected, as I would like to carry there as well.

Something to think about anyway.

All the ones I've been to have posted that there are absolutely no loaded firearms allowed. None means none. At the door, the checkers as if you have ANY guns on you. I still think it is stupid to not allow CCW in GUN show.

Conceal your handgun and don't tell the security guards at the front you are carrying. State law does not prohibit carrying handguns on state, county, or municipal property, so you are legal carrying at a gun show held on such property. I've never had a problem carrying a handgun concealed at a gun show. Policies of the gun show mean nothing legally.

Ok, I'm gonna have to call you on this one, unless I'm mistaken TN law does say we can't carry on city, county or state property (fed property is covered by another law).

If I am wrong please quote TCA so I can make a copy of it and proudly carry where I am allowed to.:)

This goes back to the old deal about what weapons are prohibited, but handguns are not on the list.

39-17-1302. Prohibited weapons. -

(a) A person commits an offense who intentionally or knowingly possesses, manufactures, transports, repairs or sells:

(1) An explosive or an explosive weapon;

(2) A device principally designed, made or adapted for delivering or shooting an explosive weapon;

(3) A machine gun;

(4) A short-barrel rifle or shotgun;

(5) A firearm silencer;

(6) Hoax device;

(7) A switchblade knife or knuckles; or

(8) Any other implement for infliction of serious bodily injury or death that has no common lawful purpose.

You are probably thinking of the code 39-17-1311 that covers weapons inside civic centers, parks, and other recreational areas. Even 39-17-1311 does not cover ALL city, county, and state property, such as the county clerk offices where you get your license plates. If the law does not prohibit it (as in the case with carrying on TN owned property) then it is legal. Legally, we could carry at the statehouse in Nashville IF signs were removed prohibiting the carry.

As stated earlier, 39-17-1311 prohibits carrying on civic centers, parks, and other recreational areas 39-17-1302(a) weapons. These are generally switchblades, blackjacks, bombs, machine guns. Non NFA firearms are not on the list. Even if you are still concerned that 39-17-1311 makes carrying a handgun illegal at a civic center for a gun show, it does give an exception for people possessing weapons at a gun and knife show. I am not a lawyer and you may want to contact a lawyer, but the law seems pretty plain and easy to understand for me.

Well lets compare: 39-17-1311 with 39-17-1305

39-17-1311 sends you to a list of prohibited weapons which a firearm or handgun is not listed.

39-17-1305 states FIREARM

So they way I am reading it is ok to carry a firearms parks, playgrounds, civic centers and other public recreational buildings and grounds as long as it is not one on the list..... I THINK LOL

39-17-1311 Carrying weapons on public parks, playgrounds, civic centers and other public recreational buildings and grounds. —

It is an offense for any person to possess or carry, whether openly or concealed, with the intent to go armed, any weapon prohibited by § 39-17-1302

39-17-1302. Prohibited weapons. -

(a) A person commits an offense who intentionally or knowingly possesses, manufactures, transports, repairs or sells:

(1) An explosive or an explosive weapon;

(2) A device principally designed, made or adapted for delivering or shooting an explosive weapon;

(3) A machine gun;

(4) A short-barrel rifle or shotgun;

(5) A firearm silencer;

(6) Hoax device;

(7) A switchblade knife or knuckles; or

(8) Any other implement for infliction of serious bodily injury or death that has no common lawful purpose.

39-17-1305. Possession of firearm where alcoholic beverages are served. —

(a) It is an offense for a person to possess a firearm within the confines of a building open to the public where liquor, wine or other alcoholic beverages, as defined in § 57-3-101(a)(1)(A), or beer, as defined in § 57-6-102(1), are served for on premises consumption.

I’m not a lawyer and I didn’t sleep at a Holiday inn last night, but I guessing you may be putting your carry permit at risk when you see big signs saying that all weapons must be checked and that you can’t carry loaded weapons.

If you don’t want to abide by the rules… don’t go in.

If the facility is legal to carry by the state of Tennessee but the company running the gun show, leasing the grounds, has this rule, wouldn't this be like going to Walmart and being "made" by the store manager? You wouldn't get in trouble, you would be asked to leave, you have not done anything criminal....right?

(If you didn't leave, you could be charged with other things like trespassing, or disorderly conduct or who knows what else."

That's how I see it.

Generally, even if a location is posted (obviously this isn't going to be a gun show location) and you are caught packing, the charge is a misdemeanor. You will be fined, but you won't lose your permit under TCA 39-17-1352.
