I've heard a lot of different stories about how people have gotten harassed by the police after they told them that they had a handgun carry permit and were armed. I guess every officer is different, but this gentleman was the consummate professional and never batted an eye.

Most cops are good people, and most people don’t tell the stories about meeting the good ones.

He didn’t have an attitude and neither did you. thumbsup.gif

Dave why aren't you a LEO any longer?

I have many reasons, but at the top is money. I’m skilled trades (Toolmaker) and at the time I could make much more as a machinist than as a cop. That is not the case today. Not to mention that if I had stayed I would have been able to retire already. :woohoo:

thanks for the story, I am a new gun owner and am planning on getting my permit soon. this is a good lesson for me, and other new gunowners thanks again

My one and only situation, was on Sam Cooper Blvd (the new part, a block from the police precinct and the new church, which the speed limit is 40 not 45 by the way), in Memphis, the cop was very nice, professional while he wrote my ticket out. I told him before I reached that I had one, where it was and he said ok as he took my dl and permit. After he handed me the ticket, I asked what he preferred and he said I did it perfect for what HE liked. He went on to say is the people he has the most problems with are off duty LEO's, they tend to jump out of the car with it on their side before the officer knows who they are. So he said, there are a few tense moments until proper id is given.

I have gone through a THP road block (labor day weekend) and only had my license ready, I did not offer my permit or inform. When I offered my license he said this is just a seatbelt/drinking checkpoint. He looked in, flashed his light and looked at all the seat belts, then told us to have a nice day.

So I guess it is more situational.

Unless it is a cop asking me for ID I am not telling them anything.

That's what I did but you know as well as I do if they had seen it they would have had a kniption fit.:D

For sure, that situation would call for no tell, no show.

This is where I get confused. Section "b" says it's a felony to possess a handgun, but makes no mention of a vehicle. Section "c" says it's a misdemeanor, but as long as you don't handle the handgun then you are ok. So which is right? Is it legal for me to have a handgun in the glovebox (never handled on school property) or not?

39-17-1309. Carrying weapons on school property. —

(:D (1) It is an offense for any person to possess or carry, whether openly or concealed, with the intent to go armed, any firearm, explosive, explosive weapon, bowie knife, hawk bill knife, ice pick, dagger, slingshot, leaded cane, switchblade knife, blackjack, knuckles or any other weapon of like kind, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, used or operated by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution.

(2) A violation of this subsection (:D is a Class E felony.

© (1) It is an offense for any person to possess or carry, whether openly or concealed, any firearm, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, used or operated by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution. It is not an offense under this subsection © for a nonstudent adult to possess a firearm, if the firearm is contained within a private vehicle operated by the adult and is not handled by the adult, or by any other person acting with the expressed or implied consent of the adult, while the vehicle is on school property.

(2) A violation of this subsection © is a Class B misdemeanor.

9-17-1310. Affirmative defense to carrying weapons on school property. —

(4) A person entering the property for the sole purpose of delivering or picking up passengers and who does not remove, utilize or allow to be removed or utilized any weapon from the vehicle.

Section B means when you get out of your car. Since the Car is an extension of your home they cannot deny you having it on you in your car. Just don't touch it or get out of the car.

Section C means that if you have to get out of your car (parent/teacher conference etc.) you may leave it locked up in your car as long as you don't touch it while on school property. Basically you have to stop 1000 feet from the school and remove the firearm to a place where NO ONE can access it until you get 1000 feet from school property again.

I went to my grandsons school a month or so ago, I planned ahead and already had the gun in the console of the truck, therefore I would not need to handle it.

Say a LEO for whatever reason asked to see my registration/ID/proof of insurance, whatever and saw the gun in my console I would have been in good shape as I was not handling the gun.

Of course this is based on me having a HCP, without the HCP you are in trouble.

If for example I was going there to pick him up and I would not need to get out of the car I could keep the gun on my person.

I figure going on shcool property the best thing is to keep the gun in the console or glovebox in case there is need to exit the vehicle.

Is there any case law that demonstrates this? I really don't want to be the first one. :cool: I frequently have to go to metro schools and various colleges so knowing the correct and legal answer is pretty important.

T.C.A. 39-17-1310(4) is pretty straight forward.

39-17-1310. Affirmative defense to carrying weapons on school property

It is an affirmative defense to prosecution under § 39-17-1309(a)-(d) that the person's behavior was in strict compliance with the requirements of one (1) of the following classifications:

(4)
A person entering the property for the sole purpose of delivering or picking up passengers and who does not remove, utilize or allow to be removed or utilized any weapon from the vehicle.

and also T.C.A. 39-17-1309©(1)

39-17-1309. Carrying weapons on school property.

© (1) It is an offense for any person to possess or carry, whether openly or concealed, any firearm, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, used or operated by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution. When I go to schools it's not to pick up or drop off anyone. I'm there to work.

Then the last half of 39-17-1309©(1) applies and you are legal as long as you leave your gun in your vehicle and don't wave it around or go out at lunch and take it out and look at it etc...

print that off dariks and leaave it in you car at all times.I have a copy of several gun laws just in case the LEO is an idiot.he may not trust your word but a copy of the law will make him think twice and ask a supervisor before he halls you of to the pokey.

To each his own. We have been over this again and again. AS long as it is well concealed, I carry. Oh how I love my P3AT, It's so easy to conceal. Well we all have to make the choice for our selves
