Interesting Question posed to me today

Recommended Posts

I do tech supportfor a small private college in Middle TN. I was told today TO carry my handgun by one of the administrators. They know I carry, they know I'm a instructor. I told them I legally can't.

Now...I've read the law as written, there doesn't seem to be any exceptions to the law. They seem to think it would be legal to carry with permission, I say no...what say you?

isnt it interesting how even the college administrators know the stupidity of the law.. and the need for protection.

I hope our legal minds on here can find you a loophole or break in the law because it is a private college or something.

The key to legality may be whether the college takes any government funds or whether the students take any government loans. There are a couple colleges in this once great nation that refuse government funding of any kind and they are not required to jump through the socialistic hoops that the rest of the education community is. Hillsdale college in MI is one that is still free to operate as they choose. I know there is at least one more but do not know where. Maybe this is one of which you speak.

I don't want to derail this thread, but comments like this really irk me. You may disagree with the policies, you may disagree with the policy makers, but there's absolutely no reason for any patriotic American to claim that this country is no longer a "great nation". That sort of talk plants seeds of treason in the minds of others. If you really feel that way, I can recommend other English-speaking countries to which you could move and laud their own "greatness". :)

I don't think it would be legal.

The law says you can't carry on any Public or Private school grounds. So not sure how they are funded or how students get money makes any difference.

There are a few exceptions, getting permission for an administrator is not one of them.

He can't legally tell you to carry a handgun anymore than they could tell someone to carry drugs.

It is a state law and he doesn't have the authority to bypass it.

Know if they want to pay you as "private police" officer...then under 39-17-1309(e)(6) you could carry.

We should legalize EVERYTHING, and problem solved!<--- to hide the redness.

Oh it gets better...I just found out they had a "incident" involving a trespasser, sissors and hide and seek with one of the security guards last night at the off campus location.

Sorry I hit upon your hot button, David. The decline of America happens to be one of my interests and hot buttons also. I am old enough to have lived in America during the better, the proud years. No one ran around the world and apologized for her. This nation was once great. People from all over the world saw her as great and provisions were made by law that enabled those who had something to contribute and agreed to certain guidelines were welcome. Today America will not even control its borders, will not develop its energy reserves, is rapidly becoming a debtor nation. Our current administration and congress is he!! bent on distributing the wealth that some of us have worked hard and smart to accumulate. The borders are open to "illegals". What do we not understand about the term "illegal?"

America is spending monies that it does not have and will be paid for by your kids and mine.

Maybe I have been listening to too many of the conservative talking heads and reading too many conservative columnists but I am not alone in my thoughts that America is in decline.

I can not fathom why expressing an opinion that America is a once great nation would plant seeds or thoughts of treason.

No, David, I love America and do not really have any plans to move to any of the countries you may have in mind to suggest. I am too old for that.

DO NOT question my patriotism. I love America and the constitution there of. I have defended her and will continue to defend the constitution.

So to keep the topic from drifting too far:

If the college mentioned by the OP takes Federal monies my guess is that you would not legally carry even though asked.

And David, if you do not like what I have to say on here I realize it is your privilege to darken my screen.........................And since this is a gun owners forum, I have a couple hundred rounds of .223 that need firing and a new gun that needs sighting in. I will try back later.

Yeah because... I'm all about censorship here.

I still think referring to our nation as a formerly-great nation is disrespectful no matter what uniform you once wore. This country is still great. Maybe my patriotism just isn't tarnished by years of negative thinking.

Have fun shooting.

I believe we still are the greatest country in the world. And I have visited many of them. There's no place like home. I will admit that many things have changed in my lifetime but I'm not aware of any place that is immune to change. As we get older, I think we all long for "the good old days". I do.

I'm sure there were some old dudes in oldogy's younger days that thought the country had gone to hell in a handbasket too. It's the burden of every successive generation to think that the one following it has screwed the pooch. Always has been, always will be.

That doesn't mean America isn't a great nation anymore.

It's the burden of every successive generation to think that the one following it has screwed the pooch. Always has been, always will be.

or is it possible that it slowly is sliding down the crapper? The WW2 generation is routinely touted as the "greatest generation". Since then liberalism (erosion of values)has become more and more and more the norm.

While I would not say the country is not great and I would never say that this is not the best place to be a citizen. There is little doubt it has slid some.

Of course the greatest generation thing I believe has a lot to do with the task it was challanged with. If Hitler came to power today and started doing what was done in the 30's culminating in another WW I believe todays generation would step up to the plate and accomplish this same task.

All of this actually does have to do with the original topic at hand. Go back 50 years and having a handgun on a college campus would not be such a big deal. Where as today it will resutl in a lot of trouble for the gun toter if caught with the pistol ( or rifle).

I see no way that them asking you to cary your piece would not have great potential to end very badly for you.

I think we are still the greatest country on earth, but I think there is the potential not to be if we don't stand up for our rights before they continue to erode further. There was a time where the Holy Roman Empire was the greatest thing since sliced bread, it too passed. Its up to "We The People" to care enough about our freedoms and our country to maintain its integrity and superiority.

It's up to every generation to uphold this country's greatness, for erosion of our liberties is constant. That being said some generations just let it erode less than others.

I had a friend in college who badmouthed the U.S. every chance he got. LOVED Europe and what not. He was born in St. Louis. I never understood why he hated his own Country but I told him once to either move or quit running his mouth.

He moved to London and hasn't been back. That was 8 years ago. BOY do I respect that guy now. I may not agree with him, but he certainly put his money where his mouth was.

Have you considered he may not have the money to get back?

This is an interesting question and I agree with the posters who say NO, you can't carry even with admin permission. The laws don't make any exceptions for HCP holders.

Is a person with an armed gaurd's license allowed to carry concealed while on duty????

This is the only potential way I see around the law as it's currently written. If you hold an armed guard's license and are working as security, you can go armed on school property (that is clear.) What is not clear is extending this beyond the clear cut version of "I'm the armed guard."

There's a ton of issues with this as well and I don't know the answers. Your job description may need to include armed security duties for the rules to apply. I also don't know if an armed gaurd's license gives you the right to carry concealed or the right to act as a gaurd if you're not in some sort of uniform identifying you as such.

I think your school's legal counsel needs to research this one and give you a written answer before you carry. I certainly wouldn't do anything on a verbal.
