Yes and no. Regardless of affirmative action laws, I don't know of any way you can be forced to hire a particular individual. At least if you're a company that didn't take the bailout and aren't part of Obama, Inc.

No she has to go through a bunch of stuff with Hr over the phone. It was one of the topics covered.

While TN is a right to work state, depending on the circumstances, the company can still be sued for wrongful termination if a person is terminated because of something a 3rd party does. It's not as cut and dry as it sounds.

If it were, there would be no such thing as "wrongful termination".

Tennessee is NOT a right to work state. This is a work at will state (HUGE difference.) This means you work at your will and the will of your employer.

If the employer decides to terminate, all he has to do say buh bye and it's over.

Wrongful termination doesn't come into play unless the employer starts trying to justify the termination and such law suits are pretty rare in this state. Most of the larger companies have well trained HR folks who know better than to do so unless they've got a well documented reason for dismissal.

The only real issue is whether or not they can prevent you to drawing unemployment by proving that it was a dismissed for cause situation
