Question ask me concerning carrying on company property

Recommended Posts

i was resently ask a question I could not answer: "If I work for a company that has a no guns on property policy, and I choose to carry anyway, can the employer have someone arrested if caught with a firearm on premises (even if there is no posting), and, should I have to use my firearm in self defense, can I be arrested for illegal carry?" I took a pass on the first question, and the answer I gave on the second was I thought if you use your firearm in self defense even though you were in a no carry zone, you could not be arrested/prosecuted for carrying.

So, I pose these questions to you guys for your thoughts or links to the proper laws. Thanks

From the State of Tennessee site: "Tennessee is known as an "EMPLOYMENT-AT-WILL" state. Generally, this means that an employer may legally hire, fire, suspend or discipline any employee at any time and for any reason - good or bad - or for no reason at all."

That said, I work, as a contractor, on an Air Force base where personal firearms are prohibited. We have an instance where an employee was fired for having a handgun under the seat of his car. It was placed there by his estranged wife and she reported him to the base's security office. I do not recall whether he was arrested.

If its private property they can threaten you with criminal trespass, but you must be given the opportunity to leave the property and then refuse to do so in the presence of LE or someone empowered by the property owner to prosecute charges privately, or you must be told to leave and never return in the presence of LE and then return to the property knowing that you were given a valid CTW.

But as already been posted they can fire you for wearing the wrong color socks if they want to.
