Invisible sign

Recommended Posts

I nearly got myself in trouble. As I went into Lenny's Sub Shop near U. of Memphis, I checked the door area for posting (even they they don't serve alcohol) and saw none except against smoking. I was open carrying. I ordered my sandwiches and had a seat at a table while waiting. That's when I noticed a silhouette of a gun with a slash through it on the door that I had entered.:D I immediately covered my gun and apologized to the manager as I had seen him notice my handgun. Thankfully, he was not concerned about it. I did tell him that I would not be back because of their policy even though I did like their food.

When I left the store, I looked at the sign and saw why I didn't see it. It was a clear decal with black lettering and slash/pistol symbol. From the outside, it was practically invisible. I locked my gun in my car and went in to tell him that if they are going to ban guns, that they need to get a sign that is clearly visible, because I didn't want others to unknowingly break the law, as in the situation that I found myself.

I don't believe the circle slash is a legal sign as far as being able to get in legal trouble for carrying where it is displayed. Especially when it's not displayed prominently.

The sign also had the proper verbiage, although you could barely see it. I also knew, after seeing it from the outside that I would probably be able to talk my way out of trouble. I used the words about breaking the law, when talking to the manager, to let him know that things are not right.

I don't carry in places that post improperly because they don't want my business.

Rant on: I wish you guys that insist on "talking to the manager, to let him know that things are not right" would stop. Just keep you mouth shut and your guns covered. Maybe they are fullfilling a corp mandate by posting. If it is not legal, then we all win. He did what he was told, but we can still legally carry. Where I work was not posted properly. Everything was ok, Security turned the other way, until some "jack-leg" raised a big stink because "you are not posted properly". Well now we are and it is illegal for me to carry. Thanks guys!!! Open carry is asking for a challenge. I know it is you "right", but why risk it? Rant off.

Sorry, it wasn't clear from your post that it had proper verbiage. I don't patronize places that don't allow me to carry either. My wife was a bit upset that I won't be going to Jared's anymore.

They can and I hope they do continue to post correctly. I wish the mall would:p:D:p

I never open carry.

That was my point. OP does, so I didn't see your comment as germane to the topic.

I carry (concealed) in some improperly posted places too, but it would be foolhardy to do it openly, unless you were just looking to be a test case.

A couple of months ago I was in Memphis shopping for a new watch and we pulled into the Jareds parking lot at Carriage Crossing. As I was looking at the front door, I saw the sign and I turned the car around and left. I spent my $1400.00 at another jewelery store that wanted my business.

Correct me if I am wrong here but the sign must be "clearly visible"

Michie's Legal Resources

Notice of the prohibition shall be posted. Posted notices shall be displayed in prominent locations, including all entrances primarily used by persons entering the building, portion of the building or buildings where weapon possession is prohibited. If the possession of weapons is also prohibited on the premises of the property as well as within the confines of a building located on the property, the notice shall be posted at all entrances to the premises that are primarily used by persons entering the property. The notice shall be in English but a notice may also be posted in any language used by patrons, customers or persons who frequent the place where weapon possession is prohibited. In addition to the sign, notice may also include the international circle and slash symbolizing the prohibition of the item within the circle. The sign shall be of a size that is plainly visible to the average person entering the building, premises or property and shall contain language substantially similar to the following:

meaning you shouldn't have to struggle to find it. Sure it is a technicallity, but the law doesnt expect you to stand in front of an establishment to for 5-10 minutes looking at all of their signs to see if they are posted properly.

Concealing a handgun properly is the best way to avoid these problems in public and a store manager asking you about your gun. If you do not conceal properly, then you risk someone seeing and telling you to leave the property. I carry a J Frame S&W in the proper holster, depending on what I am wearing...and have carried to baseball games...concerts..hospitals.reunions...church..gun shows...work...bars.school property..and no one has ever guessed and asked me to leave...of course I do travel to other states but just saying what may not be legal here is legal in other states...still locations that people wet in their pants over and where people are in close proximity. Find the right sized gun and the right holster and unless a properly worded sign in TN is noticeable it won't matter..you won't have this happen again. I don't worry about it...I live close to Memphis and sure am not leaving my gun in a car over a sign with all the thugs in Memphis.

You should have made a copy of your receipt and let them know the error of their ways. And don't bother sending it to the local store, send it to the head guy.

I found it doubly disconcerting as they also no longer employ armed security like they used to.

Carrying where posted is a loser move. That said, if the signage wasn't visible when you entered, what are you supposed to do? No harm no foul.

are you talking about the one on poplar near the recruiting station? If so I went there today and was carrying concealed and damn near had the same thing happen. I kept eating but one funny thing was a plain clothes cop came in just after i noticed the sign. I went outside to read it after i finished my meal and it was very difficult to read.

No, in your opinion carrying where incorrectly posted is a loser move. Ostensibly you feel this way because of your close association with the Law Enforcement community.

It is not smart to OPENLY carry a handgun at a place with some sign that has no legal meaning in TN. That is the whole point of CONCEALING properly. If you conceal properly and you happen to miss a silly sign, well no one knows but you. I don't sweat it because my safety is of great importance in Memphis city limits. A large handgun carried in a cheap holster covered by an untucked t shirt is just asking for someone to see your handgun when you say sit on a stool or bend over.
