What Should I Do with this $67,000?

I can't cash this IRS refund check, because it ain't mine. But me thinks it's darn cruel to send me a 941 refund check of $66,038.42. I'm not kidding. That's exactly what I received in the mail yesterday. :squint:

These meat heads kept saying I owed them money. We kept sending copies of canceled checks and duplicate forms to said meat heads.

So finally the notices that I owed the money stopped and I figured we were done with it. Then I get this check from the IRS yesterday, including $2,641.24 in interest for the 156 days that we sorted out the paperwork (all this time they said I owed THEM money).

I'm going to sue them for mental anguish. Anybody sending me a check like that and then saying "just kidding" is just downright cruel.

This is not the IRS' best hour.

David.. lets talk. I'll get the wife to cook something good and we can discuss this awful mess. Just come on over anytime. I'm sure we can work this out. :squint:

David, I have a little experience with the IRS, and it is good, but I think it's because I had two good agents to work with. I can only pray that you get someone like this. When my mother died in NC, she had not filed income taxes in seven years. She thought that the bank who was managing a trust fund she lived off of was doing it. So I had to file 7 state returns, and 7 federal returns, I had to pay interest as well as fines, and then I appealed the fines (at the advice of the IRS), and got them back. Both the state and federal agents were super nice to me, apologetic for all the time & paperwork involved, and to make a long story short, our mutual working attitudes made a bad situation end in a positive way. You need to get ONE agent to work with you on this to bring it to an end. The fact that you're not trying to keep this check makes the situation in your favor, so they should be working with you totally on this. I reeeeeelllly hope you don't have to get a tax lawyer for this, because if you do, you will need $66,038!

You should take it to the bank and deposit in a savings account. Maybe you can make a couple bucks in interest before they take it back.:wave:

When you receive a check from the IRS and you know its wrong, NEVER, cash it!! You will be responsible for interest when it is cashed as it is "their" money. Just friendly advice. I would run, not walk, to 801 Broadway in your fair city of Nashville and go to "TAXPAYER SERVICE" and ask for a Revenue Agent and a Revenue Officer.

The same thing happened to me in the 90's (a lot less money). It took them 2 years to figure it wasn't my money. No matter how many times you tell them, they can't admit it's their mistake. When they finally figured it out they wanted to charge fines and penalties for not returning it. I had to prove I tried to return it but they wouldn't accept it before they'd drop the fines and penalties.

My suggestion to you is to document everything you do about it and keep the proof for 7 years. Copies of correspondence, records of calls, people you spoke to at the IRS, every little detail.
