This is screwy, he was remodeling a mobile home (in a bad part of town) and fell asleep in his chair, mind you with the door open. Cops came by and started banging on the screen door. Guy jumps up gun in hand. Cops identify themselves and he disarms (places the gun on the floor). No wthey have arrested him for ag. assault on a police officer.

I'll find the link if I can.

Here is my question: Does that not fall under the new "castle doctrine"? I mean it was his house (he wasn't living there, no power, ETC) but in all honesty I think he was within his rights. Now he didn't start any crap, complied completely with the officers. Is Athens Pd becoming JBT'S?:taser:

Any comments?

Unless something else took place that we are not aware of, I believe this case will not stand up. At least I hope so....

He's lucky he wasn't shot. This is no good for the city PD in court unless he takes his tax attorney to defend him. After this charge is cleared up He should demand to be reimbursed for his legal expenses or sue the city for it.

From What I understand, he was woke from a sleep with banging & such so he grabbed his pistol for protection and once the cops identified themselves he placed it on the floor. So it sounded to me like he did everything right, except falling asleep with the door open.

I've tried to post the article but my local rag requires me to sign up to get it and I don't know my account number. I'll keep trying.

I agree he needs to get a big dog and chew Athens PD a new one.

There certainly might be more there than what we're hearing.

But it sounds like another abuse of power by cops who think everyone needs to surrender immediately to their will and go unarmed. They should have been prepared for almost any reaction when they banged on the door.

There was a case in the past 5 years where one of the Wilson County police departments raided the wrong house in the middle of the night. The startled elderly home owner was rousted from his sleep by the door being busted in. He came up from his bed, armed, and the police shot him dead.

Wrong house... wrong guy. Dead.

I need to find the news articles regarding it because I am fairly sure that the police more or less got away with it too.

Sounds like JBT's to me. LOTS of that going around lately as America becomes the USSA of Amerika. Sad. So very sad.
