Calling a lawyer after a self defense situation

I will never understand people who think that spending 24-48 hrs sitting in the local clink while they wait to speak with their attorney is such a horrible outcome.

Because people get beaten and killed in jail.

Club Med white guys that just killed a gang banger that was car jacking them or burglarizing their house would be a big target.

I’ve been sent too many times as an escort for the ambulance that was hauling a prisoner to the hospital.

Nope… I am not going to jail.

And I won’t have to because I have a plan that will work.

I will go to the clinker if there is absolutely no other option, but my attorney, and my options both have me sleeping semi-soundly in an emergency room for a few hours. My wife will be pissed I am sure, but I am gonna be sleeping.

Well you aren’t bonding if the cops put a hold on you. And I don’t think you are going to bond on a felony until you are arraigned. If you are arrested at 10pm on Friday night when will that be happening to you in Sumner County? :lol:

They usually keep incarcerated LE's seperated. Here in Memphis they could build a full-sized jail just for all the police who've been locked up the last few years.

Maybe instead of criticizing others opinions concerning this matter, you could elaborate on your idea of what can be done at that point and time. Many of us do have open minds and like to consider alternative view/opinions.......So, what would a former LEO do in this situation?

I don't know about online, but I am enrolled in an advanced logic class. That sir, was an ad hominem argument, an informal fallacy. It doesn't help the validity of your argument one bit.

Ya know,one could argue that you dont learn anything by taking classes,but by graduating classes.....

I have said it throughout this post. The common thread on an internet forum whenever arrest is the subject usually seems to be the misguided idea that this is some patriotic exercise in the application of your rights. Nothing could be farther from the truth. The goal here is for you to maintain your freedom and hopefully not to financially destroy your family by going to trial.

As part of your plan you need to understand that if you have a situation where you are justified in killing someone; that absolutely requires you making a statement.

Am I suggesting that you make a statement without talking with an attorney? Absolutely not. If you don’t feel comfortable enough in your knowledge of the law concerning what you have just done you need to talk with an attorney. My point is that you need to talk with him right then.

Keep in mind that we aren’t talking about the lawyer that handled your divorce or the DUI of a family member; we are talking about criminal defense attorneys that handle serious felony cases. Those types usually have a 24 hour number you can call. It may not be the direct number to them, but it will be someone that either has their direct number or can meet your legal requirements.

People are going to be arriving at the scene of your shooting; cops, detectives, you may even have someone from the District Attorneys office there. These people are going to be making decisions that could impact the rest of your life. I want either me or my attorney there and involved in that process.

There is no reason for you to be going to jail…. Period. If you go to jail it is either because your shoot is questionable or you are not cooperating.

Use some common sense. Don’t get tied up in this “The cops are out to get us mentalityâ€. I know there are many here in disagreement; but they are not. They have a job to do and with me telling them that I just killed a dirt bag that had broken into my house; they can get their investigation done faster and be gone.

Keep in mind here that we are discussing a situation where you are clearly justified in the use of deadly force.

If you have just shot someone that is breaking into your car or stealing it out of the driveway, or you have shot someone out on the street because they scared you; you are probably going to jail anyway, so timing is not really as important. :)

You don't want to go to jail because you're a former cop, and former cops don't do too well in there from what I've heard.

No one around here is going to know that. I have both been in jail and worked the jail. With what I have seen I’m certainly not going there because of misguided principals.

I have never even been inside the Rutherford County jail. Is it a nice place? :)
