If I sell a weapon to a dealer is my name taken off or not associated with the dealer anymore versus I know if I sell to an individual and something comes up, it will trace bck to me first>

Thanks,

If I'm not mistaken, the bound book has to be kept for as long as they are in business, after that it is turned over to the ATF. Not sure about the 4473's.

Of course 4473s are when you buy a gun from a dealer.

Not necessarly any paper work when you sell them one, is there?

actually, when a dealer acquires a firearm, he has to log the necessary info in his A&D records( the "bound book")

if I'm not mistaken, the dealer has to log the name and address of the seller, the price of the weapon, and the make, model, caliber, and SN of the firearm

not exactly paperwork, but there is a permanent record

Just document your sale, verify the ID of the purchaser, and keep your documentation. You can download forms for a sale to help with this right here on TGO. It's not a requirement but it may cover your butt.

Got ya....

But if the ATF does a trace they are still going to have to start at the beginning with the manufacture and the first dealer it went to, right?

true, but from a CYA perspective, if you do sell the gun to a licensed dealer, as soon as they came to you, all you would have to do would be to tell them "I sold it to (business name) on (date sold)"

that is assuming that you keep records of all dealings with licensed dealers, but then again my firearms record practices are probably a little more detailed than most...

I understand...

I was just making sure selling it to a FFL doesn't create a new starting point on a trace. Or in other words you wouldn't be by passed during a trace on it.

Glock makes the weapon and it ships to FFL A, they sell it to citizen A, who sells it to citizen B, who sells it to citizen C, then citizen C (The OP in this case) sells it to FFL B, who then sells it to citizen D. Then for whatever reason the ATF starts a trace...they are still going to go to Glock then FFL A and go from there and not start with FFL B and bypass Citizen C.

they will absolutely use that formula, I was just reassuring the OP that he would have a legal leg to stand on in the situation.

that is one reason why any gun I buy from an FFL gets disposed of to an FFL, and also one reason why I greatly prefer private transfers as well...

What exactly is the difference?

I agree...gun can be traced to at least first buyer, so at that point it really IS "registration" - so the only real difference is that subsequent FTF sales aren't "registered".

That and the fact that there's not an extra fee for doing it.

When I think of registration, I think of like with your vehicle. Every knew owner must give their information to the government. So when the plate or VIN is checked it comes back to the current owner.

So in that respect, guns are not registered in TN.

True.

But if the gummit wanted to put in the effort, they could find out most of the guns I have bought, so in true tinfoil hat sense, they would sure know where to come and try to git 'em.

True enough...

I had a deputy call me about a gun he found a few years ago....I had bought it from Wal-Mart in the late 80's
