URGENT: Winchester Tennessee is Attempting to Opt-Out of

New Park Carry Law!

Please Contact Your Local Officials!

Several Tennessee counties and municipalities have started the process to opt-out of the new park carry law before its effective date (Tuesday, September 1). The City of Winchester is considering opting out of the new law and will formally consider a proposal to do so soon.

On Tuesday, July 14 at 6:00 p.m., the Winchester City Council will consider a park carry opt-out resolution, No. 807. This resolution, if passed, would prohibit law-abiding permit holders from carrying a firearm for self-defense in local parks within city limits. This meeting is open to the public, so we encourage you to attend in support of our Second Amendment rights. All those who wish to speak at the Winchester City Council, may have the opportunity to do so at the beginning of the meeting. Please get there early.

The best way to get your opinion through to your local officials is to contact them immediately. Please respectfully urge them not to create a confusing patchwork of laws that will close off local parks to law-abiding permit holders who simply wish to be able to protect themselves and their families. Details and contact information are provided below. Please forward this email to fellow permit holders and Second Amendment supporters.

Good luck. 21 years there has proved to me that they are mostly closed-minded buffoons. I got a felony street-racing charge there because some dumb mexican in a $2 honda thought it would be cool to rev his fartcan and blow past me a red light. Luckily, Judge Farris realized how stupid a felony street racing charge would be and bumped me down to a speeding. Even though I wasn't speeding, it's a lot better than a felony.

Seems like this is becoming common practice all over the state. Everyone seems to want out.

If I understood the notes in the Trenton City Council meeting's agenda, it said the league had contacted the city (so probably all cities) about the parks carry law.

Didn't really say the urged them to go one way or the other, but I have noticed that many of the resolutions are worded the same, so make me wonder if they have provided a "sample resolution" for cities to use?

Local Opt Out Prohibiting

Handguns in Municipal Parks

Pursuant to the recently passed

Public Chapter No. 428,

as of September 1, 2009, handgun carry permit holders

can lawfully possess handguns in Tennessee’s federal,

state and local parks. Local governments can opt out of

these provisions and continue to prohibit handguns in

parks they own or operate by passing a resolution and

erecting appropriate signage.

Seemingly a city can, through appropriate resolution

language, opt to prohibit handguns in specific parks,

while allowing them in others. However, no individual

park may be divided into handguns-allowed and

handguns-prohibited areas, as a prohibition applies to an

entire park. Upon passing the resolution, the city must

post prominent signage in parks where handguns are

prohibited. This signage must be in accordance with

T.C.A. § 39-17-1311©(1).

The provisions allowing handguns in local parks take

effect on September 1, 2009, and on that date any city

that has not adopted an appropriate resolution will lack

the authority to prohibit handguns in its parks. Cities are

authorized to adopt resolutions as of June 12, 2009.

I think the part that cities have to opt out by Sept 1 is wrong. But that could be why so many cities are hurrying to vote one way or the other.
