New "Yellow Sheet" - Form 4473

As of today, gun dealers are using a new Form 4473. I've started calling it the "Cho Sheet."

I think the only difference from the previous forms is question 11 (f)

This previously read:

Have you ever been adjudicated mentally defective (which includes having been adjudicated incompetent to manage your own affairs) or have you ever been committed to a mental institution?

The new question is:

Have you ever been adjudicated mentally defective (which includes a determination by a board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR have you ever been committed to a mental institution?

The "OR" in bold is their emphasis.

It's still Yes-no-no-no-....

People really need to figure out that the problem isn't whith people being able to arm themselves but whith the number of people who neglect doing so.

ATF REVISES FEDERAL FIREARMS TRANSACTION RECORD FORM

WASHINGTON – The Bureau of Alcohol, Tobacco, Firearms and Explosives

(ATF) reminds federal firearms licensees that effective Sept. 1 they must use the revised

Firearms Transaction Record Part I – Over-the-Counter (ATF Form 4473).

“In the immediate aftermath of the tragic events at Virginia Tech in April, many

questions arose about whether the person responsible was prohibited under federal law

from possessing a firearm and how the shooter passed the background check required

before purchasing the two firearms used,†said ATF Acting Director Michael J. Sullivan.

“ATF is clarifying this form in an effort to make it clear that any person who has been

found by a court board or other lawful authority to be a danger to self or others is

prohibited from purchasing a firearm or ammunition.â€

The form clarifies the question regarding “mental defectives†and incorporates the

definitions of this term set forth in the regulations, 27 CFR 478.11. The revision also

incorporates certain provisions of the Violence Against Women and Department of Justice

Reauthorization Act of 2005 (Public Law 109-162) by adding “tribal offense†and “Tribal

Law†to the definition of Misdemeanor Crime of Domestic Violence.

ATF is a principal law enforcement agency within the U.S. Department of Justice

Until federal law dictates that states must disclose that medical information to the federal government and are immune from prosecution under HIPAA it doesn't matter. People are still going to lie on that question. Those who want to be armed, legally or illegally, are going to find a way to get the weapons they want.

Isn't that true of ALL gun laws? The more laws we have, the more laws will be broken by some one who wishes to use a firearm for evil.

I see the move as simply a CYA by the BATFE, so they can be seen as "doing something" about this problem. It was a massive waste as I had to toss about 50 of the old forms and order new ones.

And no, it won't prevent any prohibited persons from getting guns.
