I'm am currently a resident of NY and I'm moving to TN in a month or so...... I have never owned a handgun because the laws in NY are sooo harsh. I was convicted on a misdemeanor DWAI over 3 years ago. Would I have any trouble getting a handgun or carry permit? I have no other convictions. If the misdemeanor is a problem are their waivers that are granted for this kind of situation or am I S.O.L. for another year and a half till 5 years has passed? Thanks!!!

From the TN website:

The applicant has not been convicted of the offense of driving under the influence of an intoxicant in this or any other State two (2) or more times within ten (10) years from the date of application and that none of such convictions has occurred within five (5) years from the date of application or renewal.
The way I read it, if you have just one DWI conviction you can get a pemit. The prohibition only kicks in when you have 2 or more (and one of them can't be within 5 years of application).

At least that is how I read it. I may be wrong.

ok thanks...... that makes sense I guess I was reading into it too much. I can't wait to get to Tennessee!! I love NY and all but I'm ready for a change. Any good shops near Chattanooga that I can get a handgun fairly reasonable?

Well nothing is set in stone yet but hopefully Chattanooga........ I am going down there in a week or so for an interview. I'm sick on NY winters and the BS here. So does anyone have any more input on my original post about my dui and getting a carry permit. It looks like I won't have a problem cause I only have one and it was a misdemeanor.

SWEET!!!! I'm looking at a Ruger LCP 380. This will be my first hand gun. It's cheap and looks like it's getting some good reviews....... any suggestions???

The LCPs are nice, but .380 ammo can be a little bit tough to find, and it is often expensive, not to mention the little pocket guns are not exactly the most pleasant things to shoot. In the same price range, there are a variety of options, used Glocks, XDs, snub nose revolvers. I'd try a few things before settling. Especially since this will be your first as you say.

ok sweet...... I have an old army ruger hand gun that I might want to trade in for something. It has never been shot but I'm not sure I want to part with it.

Never get rid of a gun. Only add to your collection! I made that mistake once and have regretted it ever since. I suggest looking around until that special one finds you! Yes, I'm talking about a gun :pleased: You'll know by holding it, feeling it and looking at it if it's the one for you. Good luck on your move to the south and finding the right gun.

I moved to TN 14 yrs ago from Massachusetts. Compared to their rules, TN is very handgun friendly. You will have to jump through a few hoops to gain your precious "handgun carry permit" but believe me, it's well worth it.

TN is great where they have all of their laws (on the internet) for public access. As far as obtaining a "handgun carry permit", I would concentrate on section 39-17-1351. Handgun carry permits only. Your required safety class (ranging anywhere from, say, $60-$100) will go over the laws (especially the dont's.) However, be warned you cannot carry as you please without a permit... but you are allowed to own a gun & keep one in your home so long as you aren't a felon.

I'm wondering how TN's "instacheck" system works with out-of-state purchases, this question is for xsmwsx and any other TGO members... I suggest you go check out a privately owned gun store (not Walmart!) and you'll find someone who will fill you in. Be courteous and polite and you will get the same in return!

p.s. Welcome to TN! You will find the pace a bit slower and less hectic than NY. It took me a few years to "slow down" the speech & driving, and get used to the higher humidity & temps.

Sweet yall........ I'm excited to be going down there. Hopefully I will be there in the next month or so. From there I will start looking. How long does it usually take after you get down there. I'm assuming you can't just go in without a TN Drivers Lic.

hate to disappoint you but unless somethings changed very recently your going to have to wait another 2 years before you can get your HCP... The law clearly says you cant have a conviction within he last 5 years. Sorry.

You can call the States HCP office if you like .... 615-251-8590

Btw, welcome to the board, when you get ready for a permit give us a call we have been teaching the class here in Tn longer then anyone.

nope its 2 in ten years... 1 in 5 years. Even if you have a HCP you get a DUI you lose it immediatly.

You have to be 5 years and 1 day from your last DUI conviction.
