I can't believe this! Will someone tell me why the News Media (Fox included) is completely overlooking this? Will someone please tell me we don't live in a police state? Don't confuse this with "Miranda Rights." I think we still have those!

Pretty soon we will all drive gov't owned cars, work for the gov't, eat gov't provided food, and go to gov't run hospitals. Oh boy! I can't wait!!

This thread title is misleading. The Supreme Court is not doing away with the Sixth Amendment. In fact, the defendant in this case had been given a lawyer. The issue is that he was interrogated after he had been given a lawyer, without them being notified. However, it is only the defendant and not the attorney who can invoke Miranda rights. In this case he never did. Apparently, after he was given a lawyer (he was indigent so they automatically appointed him a public defender) he was again read his Miranda rights and said nothing. Because he waived his rights, he was allowed to be questioned.

What the court is basically saying is that there's a difference between being automatically, unilaterally given a lawyer, and actually speaking up and asserting your right to counsel and to not be questioned. Miranda doesn't kick in until the second one happens.

Some might see this as a dirty trick by law enforcement (and no doubt, I'm sure, the defendant's lawyer was royally pissed) but it's not illegal. They played by the rules.

If Im not Mistaken you were the one that started the thread about Dick Chennys wonderful speech about how the Bush administration protected us after 9/11. Why all of a sudden are you concerned about our rights? They have been doing this to "Terrorists" like Ashton Lundeby a 16 yr old in North Carolina since the PATRIOT ACT was passed. All they have to do is call you a Terrorist and you have no rights, We can thank the Bush Administration for that.

If you read other articles about that case, I think you find out that mother was exaggerating, she knew he had been doing crap, and he was not denied anything legally that you would normally have a right to. But if you scream crap like "Patriot act", you will get more media attention and she knew that.
