Governor Phil Bredesen Vetoes HB0962 (Restaurant Carry Bill)

I emailed my state representative and state senator yesterday. Since my representative has never deigned to reply to any correspondence I have sent him for one-and-a-half terms, I also sent a copy to Representative Bass.

My letter:

Representative X, I am one of your constituents. I respectfully urge you to vote to override Governor Bredesen’s veto of HB0962. I do note that, on the final vote to concur with the Conference Committee Report, you did not vote either way. You did not stand in the way of the bill’s passage, and I do thank you for that. I fear that, on this vote, simply not standing in the way will not suffice.

At his press conference, Governor Bredesen has stated, “The notion that we would pass a bill, that we would have a bill now that would now permit one to carry a loaded concealed weapon into a crowded bar at midnight on Saturday, I think defies common sense.†This is specious political posturing; Governor Bredesen knows that the bill transmitted to him by the General Assembly contained specific language designed to limit carry to eating establishments which serve alcohol, and he also knows that the holder of the handgun carry permit is specifically forbidden to consume alcohol while in possession of a firearm, both in this bill and in statutes.

Approximately forty states currently allow licensed firearms owners to carry their firearms into eating establishments that serve alcohol for on-the-premises consumption. This number includes virtually every state contiguous to Tennessee. Perhaps Governor Bredesen’s contention is that law-abiding Tennesseans are so intellectually and morally deficient that they cannot be entrusted safely to do what the citizens of eighty percent of the other states in our country can do. Now, due to the governor’s veto, our state’s criminals (who by definition obey no law) will potentially remain safe from the Nikki Goesers of this state:

I have personally met Ms. Goeser, and I know that this is a true account of her beliefs.

Since the Supreme Court of the United States has, in the recent Heller decision, affirmed that the Second Amendment is an individual right; since the Ninth U.S. Circuit Court of Appeals has held in Nordyke that the Second Amendment is incorporated against the states in its jurisdiction (not Tennessee, of course); and since the Tennessee Constitution affirms the right of the people to keep and bear arms, I must again respectfully urge you to vote to override Governor Bredesen’s veto of this bill.

Tennessee’s General Assembly is given the power by the Tennessee Constitution to regulate the bearing of arms with a “view to prevent crime.†I would again ask you to peruse Ms. Goeser’s story referenced above to judge if the state of current law “prevent crime.†I submit that the governor’s veto will abet crime, not prevent it. To borrow from Thomas Jefferson, the right of the people lawfully to defend themselves from crime is a right “inestimable to them, and formidable to tyrants only.â€

Please support the law-abiding permit holders of Tennessee by voting to override the governor’s veto of HB0962, and by encouraging your colleagues in the House to do the same.

I called the Guv'ners office to leave a message, letting Phil know "I am sorely disappointed he won't be running in the next Election... Because I would have loved to have had the opportunity to have went to the polls and cast my vote AGAINST him"... She didn't even respond to my comment...

Thank you for your recent communication regarding HB962. I appreciate

you taking the time to contact me on this matter.

I originally voted for this bill and feel that, under the second

amendment it is a right of the people. I am opposed to the Governor's

veto.

You have my assurance that your concerns and suggestions, as well as

those of my other constituents, will be reflected in my decision making

process as the Senate continues its work.

According to the TN AG it is just as illegal for an LEO to carry, on or off duty, in an establishment that serves alcohol unless it is in the execution of law enforcement duties. Having lunch or dinner is not an official duty.

Even though Haynes is against the bill you should still send him 2 or 3 emails a day until the house has acted on the bill. My Senator is Doug Henry and he is the most useless Senator on the hill but he is getting multiple emails anyway. Their job is to represent us. Our job is to tell them what we want. I think that it is vital that we do our part no matter how futile it may seem.

We both know he's useless, as I'm sure many others do also, but if I don't send my Senator my thoughts on the issue then I'm not doing all that I can do. I don't know how many more of us here on TGO live in his district but we should all send one or two emails a day to him anyway.

I would like to see everyone on TGO send him as well as the others that voted against the bill multiple emails until this gets done. It's more useful than spending all of our time on TGO just *itchin.

Assuming for a moment that the restaurant bill does override the veto, since it was supposed to go into effect June 1, does that mean the moment whichever clown in the Senate drops the gavel, it becomes effective?

I actually got a message from Sen. Jackson. Man I wish all the elected officials were like him.

Oh and he has filed a motion to over ride the veto.

No kidding. I'm lucky, got Paul Stanley over here and have had multiple email conversations with him as well. He also is very very strong supporter (co sponsor I think?) of the Sen version of the bill. My correspondence with Sen. Jackson stemmed from me thanking him for standing up and preaching the truth about us permit holders.

at 11:50pm, I wrote a letter to bo watson and vince dean asking them to vote to override. I also wrote to gov. b. telling him how displeased I am with his decision. while I was writing gov b I got an email from bo watson. This is what I wrote:

"Please allow me to introduce myself. I am Darin Linkins, a resident

of East Ridge, TN and a handgun permit holder. I am writing to ask

you to support HB0962 in the override of the governor's veto. As a

Handgun carry permit holder and a Husband and father of 2 boys, I have

three very good reasons to carry. Their names are Shaunna, Maverick

(age 2), and Dylon (age 3 mo). They are the reasons that I got my

HCP. We, as law abiding citizens are not the people that people

should worry about when it comes to having guns in restaurants that

serve alcohol. It is the people that do not have them, carry them

anyway, and do not care about the law that are the problems. I would

like to be able to go out to dinner and feel confident that my family

is secure. When I take my family out to a restaurant, I do not drink.

The Governor said that Guns and alcohol do not mix. This is a true

statement, but he left an important part of that out... guns and

DRINKING alcohol do not mix. Law abiding HCP holders know and

respect that. Please do the right thing and support the right of the

people of Tennessee to keep and bear arms. I would like to be able to

eat dinner in Tennessee restaurants that serve dinner. Right now, I

go to Georgia to do so. They do not have this law and where are all

of the cases of permit holders causing problems in that state or any

of the other states that do allow this right. Thank you for your time

and consideration.

I have supported this legislation each time it has been presented. I have been advised that the veto override will be debated next week, but that will be up to the Senate sponsor, Senator Jackson.
