Thanks for contacting me, and thanks for the kind words! I plan on voting to override the veto. As both a HCP holder and state certified HCP course instructor, I don't think we need to ban law abiding HCP holders who arent drinking from carrying in restaurants that serve alcohol. Drawing these imaginary lines around certain places only prohibits good citizens from carrying, because the crooks will carry whenever and wherever they please.

I have found the AG OP which makes it illegal for one to do so off-duty (99-024: AG 99-024), but I don't see anything about on-duty carry. Is there another opinion? What am I missing? :)

I think the law has changed since that opinion.

I admit I was once one that that in the "actual performance of their duties" meant more than simply being on the clock. But others were able to make some pretty good arguments (in another thread a while back) and have me at least convinced enough that even if they are eating lunch, there is enough gray area that no one would charge them.

But if you makes you feel better, I saw a committee meeting last year where Serpas and a Representative debated this and each had opposite ideas and weren't fully sure.

Anyway....here is the law on officer carry.... 39-17-1350

I've been a lurker here for some time. Figured I didn't really jhave anything great to add.

I contacted my legisltors regarding the veto.

I got a good reply from Senator Ramsey:

huh, now I feel much better and safer after that bill has been vetoed...now I know that crazy armed nutcases wont come in the bars to kill people because it is against the law.... huh, what a relief... now we need to outlaw CCW carry period, in the whole country and that will take care of all the shootings and killings and crime will vanished forever... how comforting...

Let's outlaw war while we're at it! Why didn't we think of this before?!?! That will solve everything. No one will ever be killed again because there will be a law against it saying so. :)

I'd actually spoken with Lt. Gov. Ramsey after church two weeks ago concerning the status of this bill, as well as parks carry. At the time, he felt everything was in good shape with both....and I can certainly vouch for the fact that he is an ardent supporter of this legislation!

Emailed Rep. Mumpower, haven't heard back yet, but pretty certain all is well there.

guys this one's getting overidden next week. What scares me is if he will veto other gun legislation and the Legislature will be out... that will mean overidden in Jan or come back in for a special session.

Not trying to be negative but thats what were looking at so when contacting your legislature please ask them to stay in for a few more days until all the gun bills pass.

Emailed Barnes.... twice, and have recieved nothing back.... called office and left message with a young lady there.... will try to catch him at "his" Subway food plot next week.

According to the TN AG it is just as illegal for an LEO to carry, on or off duty, in an establishment that serves alcohol unless it is in the execution of law enforcement duties. Having lunch or dinner is not an official duty.

I see Murfreesboro Police in Logan's all the time and they are carrying. The law must not apply to them.

I feel good about this one. It is going to be embarrasing to Phil but one thing is for sure....the veto override will not be on TV with speakers and a backline of police chiefs and district attorneys!

I'm out of town for a Caribbean cruise for one week... just one week... get back... and I find out that Bredesen sold us out!?! :eek:

Man... he can forget about ever getting support from this been-looking-forward-to-going-armed-to-protect-my-family guy!

I got a voice mail from Rep Curry Todd this evening and he said the Veto will be coming up for vote Wednesday morning. He also said there is a lot more support for overriding the veto than the opposition does, should be done Wednesday.

From other info I have posted, as soon as that is done, Sen Jackson I assume would bring it up on the Senate floor.
