Nashville Pre-emption Resolution"

According to today's Tennessean, "Metro Council members passed a resolution last week criticizing the legislature's efforts to dictate gun laws for local parks." Guns-in-parks goes to Tennessee governor | tennessean.com | The Tennessean ) When I wrote my council person about this, I was told that the "resolution was more about the General Assembly's attempts at local pre-emption," inferring the resolution had nothing to do with the Metro closing off Metro's parks for carry. Does any one here have the skinny on what's going on with this Nashville issue?

Were they able to change the park bill to require a 2/3, or 3/4 vote majority to close parks to permit holders, or it still only require a simple majority?

I didn't read all of the resolution they passed, but I think this one was just to say the disagree with General Assembly. But if they passed that one, passing one to ban carry in their parks probably wouldn't be hard.

...and it will only require a majority vote.

Thanks, Fallguy! - Here's a link to the resolution:

RESOLUTION NO. RS2009-790

Being non-binding, isn't that basically a vote for the record, and has no real bearing on the bill?

Heh... Nashville's too broke to put up new signs and are b!tching 'cause they'll either have to, or allow guns in the parks. :)

I've been in a rather heated e-mail debate with the ...person that co sponsored the resolution. They're dead set against it, and the resolution was signed by carpetbagger dean today.

I believe the law on the govs desk allows the parks to be closed with a mere resolution by a city council. IF this is the case and it makes it into law, I'd bet various body parts that the very next Council meeting the metro parks are all closed

Yes, I'm aware of that.

I suppose I should have qualified it by saying legal guns, but I assumed you all would know what I meant. :)

i'd say every entrance and exit thats available to the public :)

LOL...well the current law (and the bill leaves this intact) says...

As used in this subsection ©, “prominent locations about public recreational property†includes, but is not limited to, all entrances to the property, any building or structure located on the property, such as restrooms, picnic areas, sports facilities, welcome centers, gift shops, playgrounds, swimming pools, restaurants and parking lots.

But I wouldn't swear that every single one of those locations would have to be posted before a judge would to still convict you.

I'm guessing if the entrance to the park is posted, it won't matter if the restroom is or not.

Might depend on the judge......

But not sure I'd want to take it that far.

Remember a conviction for a Class A misdemeanor means losing you HCP until what ever sentence you get is completed, including probation.
