Last week, i attended a 'private' block party in a public park in town. It was invite only to members of the organization.

I carried in (concealed.. past 2 cops) but when i got inside the perimeter (which was fenced off) i found they were serving free alcohol.

I was unsure whether this was covered under a licensed premise serving alcohol or what... so i went and stashed my weapon in my vehicle and returned to the party and enjoyed the night.

here is my question to all...

do you think i would have been legal if i had continued carrying?

there were no postings...

the public park was fenced off making a private area.

invite only.. thus a private event...

free alcohol being served.

thoughts?

ps.. i dont want to hear 'you should have carried anyway etc etc' i wanna know what the correct legal thing would have been...

it wasnt a 'state park' i dont think... more just a city park on the corner of a block in downtown nashville.

Owen Bradley park to be exact if anyone knows the place

hmm, thats an interesting scenario. its funny how much stuff is unclear about CC. seems to me that if there wasnt alcohol there it would be fine, being that it was a private event. but then again doesnt the law state "nowhere where alcohol is sold" or is it nowhere where its served? i think it comes down to that.

Served. Mapco and Kroger sell, but don't serve. O'Charley's and The Palm serve.

As of today it is illegal to carry in any local, state or federal park in TN. The law 39-17-1311 doesn't seem to make a distinction anywhere in it as to if part or all of the park is closed off for a private function.

Had it not been in a park though I think you would have been legal (as long as you weren't cosuming) for two reasons. It was outside and was a private function.

As of today the law is...

39-17-1305 Possession of firearm where alcoholic beverages are served.

(a) It is an offense for a person to possess a firearm within the confines of a building open to the public where liquor, wine or other alcoholic beverages, as defined in § 57-3-101(a)(1)(A), or beer, as defined in § 57-6-102(1), are served for on premises consumption.

You were not within the confines of a building and it was not open to the public.

That was a private party, not open to the public.

I didn't see a posting. If you wanted a drink you did the right thing.

Nothing unclear about it at all. If you were carrying in a Metro Park, you were breaking the law.

i was feeling that part of it.. but was unsure if anything would have changed since it was not open to public and fenced off.

I guess technically i didnt break the law as i didnt make it off the street into the 'actual park' before i realised alcohol was being served etc etc
