Whereas, it has become necessary to call into service not only volunteers but also portions of the militia of the States by draft in order to suppress the insurrection existing in the United States, and disloyal persons are not adequately restrained by the ordinary processes of law from hindering this measure and from giving aid and comfort in various ways to the insurrection;

Now, therefore, be it ordered, first, that during the existing insurrection and as a necessary measure for suppressing the same, all Rebels and Insurgents, their aiders and abettors within the United States, and all persons discouraging volunteer enlistments, resisting militia drafts, or guilty of any disloyal practice, affording aid and comfort to Rebels against the authority of United States, shall be subject to martial law and liable to trial and punishment by Courts Martial or Military Commission:

Uhhh...didn't the Southern states start the secession illegally? Really, I can see both sides of the argument for the civil war when it comes to slavery. No where in the Constitution does it say it say rights are for whites only. Since it doesn't, I would say that slavery was unconstitutional. At the same time, I understand that we don't want the Feds getting into our business when they don't have the power or going after the states for something that is constitutionally allowed.

According to the Federal government, yes. Just like they would later claim the Branch Davidians were manufactoring methamphetamine.

I can only see the side of the argument that wouldn't end with over half a million dead Americans. The war was NOT about slavery. Delaware, Maryland, Missouri, & West Virginia all allowed the owning of slaves right up until the end of the war.

Agreed. But unfortunately, it DID specifically allow the owning of slaves until it was later amended, thankfully.

It wasn't made unconstituional until the end of the war, sadly. Again, 5 Union states allowed the owning of slaves until the end of the war.

Most states were divided in regards to owning slaves. Tennessee was very much so. East Tennessee was very anti slavery while West Tennessee was very much pro. It would have ended eventually, just like it did in most other countries. We didn't need a war.

Shoot, in Mississippi, in their laws it was not illegal (though, federally it was) until 1995. I remember some Big media attention about it.
