Should the Gun store take a malfunctioning gun back?

I bought a new gun and in a weeks time it started malfunctioning. I took it back to the gun store and they said I would have to take it up with the manufacturer as it is under warranty.

Some others have told me that the store should've taken it back since it was only a "week old" or so recently new.

No gun store will take back a fired weapon to my knowledge. All of them rely on the manufacturer to honor warranty claims.

Edit... Apparently some shops will! Read below. :yum:

I cant speak for all shops, or all situations but I will tell you that we have taken guns back due to malfunction, and then dealt with the manufacturer at a later date.

We have usually offered to swap the defective gun for another of the same type, or if the customer wishes, roll the amount paid for the original gun into a new one of their choice.

Customer, Gun, Malfunction, Situation, and what I had for breakfast will vary.

I was thinking they could sometimes do as they wished as most retail places can.

I have been lucky to not have had any issues with my firearms after being purchased. However a buddy of mine did with a Taurus he got. Turned out the mag was screwed up and kept causing it to jam. Same mag every single time. Byrds over here in Jonesborough took care of it. He has been shopping with them for a while now.

Though they never seem to give me the best prices they seem like a good bunch. My recent purchase is through Tri Cities Gun Depot as they gave the best service and price. I hope that if there is an issue, they will help take care of it.

I didn't want the post to get crapped on if someone got upset by dissing their favorite gun or store so I left that out of the post.

Personally - I would have just called the manufacturer myself and gotten it taken care of that way.

But I guess if a store - like Hero Gear - chooses to go above that and resolve the issue themselves (love the upsale - I'd probably take advantage of that!), I guess they can.

I actually had a gun store take a pistol back that I purchased for my wife (SW 38Sp Snubby, dont remember the model), she put about 30 rounds through it and hated the gun...I called the shop and talked to the owner about bringing it back for a trade, told me to bring it in, So I cleaned it carried it back excpecting to recieve a reduced value for trade (rounds through were fully disclosed) owner stated No, I want her to have a gun she is cofortable shooting, full value on the trade...Purchased another pistol (bersa 380; her pick) ; later that had some malfunction about a week after...same treatment, took the malfunctioning gun handed me a brand new one...Lawsons Outdoors in Loretto..Turned out it was only a spring so we fixed and i took the original home and it hasn't missed a beat since...Hero Gear has the right approach, this service after the sale builds loyalty and free advertising that no amount of money can buy...word of mouth can make or break a business...
