HB0962 and the Senate

Well, the cooler head prevailed and I didn't email Jackson. But I disagree that anything good can come from dragging this out any further at this point. How is postponing this helping other gun bills? They had to push the long gun bill back so it wouldn't be right on top of the restaurant bill.

I've lost track of the parks bill at this point. I know the fingerprint bill, which even the TBI endorsed, went to Bredesen's desk. Did he even sign it?

I'm not saying this is the case, however lots of bills get passed in the last few weeks without a lot of debate or discussion in the legislature or by the press simply because of trying to get everything done before they adjourn.

The parks bill HB0716/SB0976 is scheduled to be heard at 3:00pm this afternoon in the Senate Finance Ways and Means committee.

The thumbprint bill HB0254/SB0554 was signed into law by the Governor.

you didnt have to send him an email, his family, and most likely he read your comments right here on this board... before you changed them. So honestly your foots tickling your tummy right about now. Have you even read this thread, or at least the posts sense you posted about Senator Jackson? The point is if you don't know enough to be able to track these other bills you mentioned and stay in the loop, then you sure don't need to call out a member of the legislature when its obvious you have a lack of knowledge on the subject.

Sorry for calling it like I see it, but you owe the man an apology. Sometimes its better to think before one opens their pie hole.... especially when representing the NRA with your sig.

I will blanket apologize to everyone for my doubts about a clean bill etc., once this damn law passes. As you've said many times on here, "I've been disappointed before". Yeah, it's looking like a done deal, and like I said, I'm not being impatient because I can't wait to carry. I just know that **** happens and until it becomes law it can be derailed by an unforeseen circumstance. And if it doesn't get done now, in the current atmosphere, it could be another several years before we get another chance. Remember, in the next election if the Dems pick up a seat or two, Neifeh could be back as speaker again.

Btw, though I don't take internet banter personally, I do find you're questioning my membership in the NRA offensive. I support the NRA, to the extent my wife and I are both Life Members. I go to the conventions and vote. But that doesn't mean I agree with them 100% on everything.

Nor that I give up the right to speak my mind because I'm a member.

I'd still like to know the rationale for not bringing the conference committee report back to the Senate at the first opportunity. There still is no agenda for Thursday on the Senate's website. If this is a "he can bring it up whenever he wants" issue, so why the delay?

And yes, I've read every post on this thread. And I still don't see any connection between having he Senate accept the report of a bill exactly the way they sent it to the committee as having anything whatsoever to do with other pending legislation.

I pretty much agree with your thought process with regards to why this has not already been re-voted on in the Senate. I am not however going to ride Sen. Jackson about it because based on my previous correspondence with him I do trust that he is holding it back for some specific reason. I know what you mean when you say that the longer we delay the more there is a chance of something going wrong, but at this point I really don't think there is anything realistic that could derail this bill.

I want this mess done as much as anybody but at this point I think it is just a waiting game. Also, it seems that the Senate hardly ever posts their Thursday agenda earlier than Wednesday evening.

But even if a bill does not pass before they adjourn this year, it would pick up where it has been left of next year since it would still be within the same session of the legislature.

Sessions are for 2 years, this session is 2009-2010. A bill can can carry over from one year to the next in the same session. Only if sessions adjourns and a bill doesn't' pass would it have to start all over the next session.

On a side note....the parks bills HB0716/SB0976 has just passed in the Senate Finance Ways and Means committee. It now goes to the Calendar Committee

Another note...Sen Kyle said to Sen Beavers that maybe she was privy to information he didn't have (about House intentions). So it stands to reason if even all the legislators don't know all that is going on...it is very reasonable that we don't know everything.

LOL....well I don't think that will happen with this bill, just wanted to note that's not dead even if for some reason it didn't go any further right now.

The bill's status page shows it has been places on the Senate's Message Calendar for Thursday.

Firearms and Ammunition - As introduced, allows person with handgun carry permit to carry in restaurants that serve alcoholic beverages as long as such person is not consuming alcoholic beverages and such restaurant is not an age-restricted venue. - Amends TCA Title 39, Chapter 17.

I thought the age restricted venue part was taken out??? Did this get slipped back in during the week? If so, don't tell me it has to go back to the House again? What happened to the "clean" bill with no restrictions?

What you quoted is the summary of the bill when it was filed. The usually don't change that summary no matter what amendments or other changes are made to the bill through the process. But the short answer is No, they have not added the age-restriction back in.

Hopefully June 1st 2009 I will be able to go to Outback and get a steak again.

I sure would trade this bill for the one that would force my employer to let me have myy gun in my car when it is on company property though...I am at a lot more risk driving to work than I am eating, especially considering the neighborHoods I have to drive through to get there.

I'd be very pleased if we could get either, as long as the parking lot bill covered *all* parking lots. Hopefully in the not so distant future we'll have both of these unnecessary restrictions removed.

HB962 is on Thursday's message calendar in the Senate. First item, I believe...

For those who wonder when it will be brought up, the usual order is:

personal orders (recognizing friends and constituents in the gallery, honoring people for this or that),

consent calendars,

regular calendars,

message calendars,

unfinished business (from previous sessions).

The session will start around 9 am on Thursday.

My understanding is that the bill's summary has been updated now to reflect the House's adoption of the conference committee report.

Wow, you really aren't a 'glass is half full' kind of guy are you? The curfew wasn't in the bill's summary which is what was quoted. They're not trying to sneak something in, the bill is running it's course. We've cleared the toughest hurdle, the House. Stop looking for the boogey man and let the process happen.

The original House bill did not have the curfew in it. See here.

On 3/30/09 the curfew was added with House amendment 1 (see here) which passed by 64-29.

On 4/6/09 13 more amendments were introduced in the house (2-14) all either failed, were tabled or withdrawn and the bill passed 70-26.

On 4/16/09 the Senate passed Senate Amendment 1 (see here) which removed the age-restricted venue and the curfew and then passed the bill on the same day.

On 4/23/09 the House non-concurred with the Senate changes.

On 4/27/09 the Senate refused to recede from it's changes.

on 4/30/09 the House refused to recede from it's non-concurrence. And appointed a conference committee. The Senate also appointed a conference committee

On 5/4/09 the conference committee met and issued a Majority report (see here) to accept Senate amendment 1 (see above) as the final version.

On 5/7/09 The house passed that version 66-23

On 5/14/09 the Senate is scheduled to vote on this version.

The final version does not have the age-restricted venue or curfew in it. The summary on the bills main page is reflective of the bill as introduced and has not been changed.

I'm really not sure what else to say or do to dispel any fears of what is being voted on.

Well....I admit to really know what is going on you have to read further than just the summary of the bill. You have to read the actions on it and follow what has happened to some degree, if it has been amended etc... If you don't your liable to not fully understand what is going on.

But I believe myself and many others have tried to keep all of TGO fairly up to date on what is going on.

What if anythihng will happen to those few amenements that were tabled? IIRC, one was going to make it a felony if one with a permit was caught drinking while packing in a restaurant.

I don't think they can come back up as the bill will not go back before the house.

But for shear procedural discussion, it takes a 2/3 vote to remove a bill/amendment that has been tabled.
