Guys IMHO all this stuff about making cans and SBR's and SBS's without the tax and going through ATF is just a dream. Ive been studying the NFA for quite a while and there is no way that ATF is going to let laws that have been in affect since 1934 to be skirted around like this. Trust me there is NO ONE who wishes that NFA stuff was cheaper and easier to get then me but I cant see this happening. Flame on....

Well, the one thing we have to think about is exactly who will be manufacturing / selling the products. I highly doubt the ATF will allow one to keep a dealer or manufacturer FFL if they start doing this in the local level. To use Hero Gear as an example, do you think Joe would be willing to risk his FFL, meaning he could no longer sell anything not manufactured in the state of TN, just to sell some extra suppressors? Do you think a manufacturer would be willing to manufacture products only sold in TN (as I doubt the ATF would let their FFL stay active to sell outside of the state)?

I think that when / if this passes there will be a rough period watching things shake down. The ATF won't allow this to go quietly, regardless of the legality of their actions.

You must not know how the BATFE opperates do you? They WILL find a way to stop it. There are people sitting in Federal prison right now who will tell you how the BATFE plays.

I think that's what it will take. So be it, it's still a state's decision, imo.

I believe at first this is going to be very dangerous ground to tread on...It has already been mentioned the ATF is known for not playing by fair standards.

Ultimately the States themselves will be the ones who must test their own legislation and it will be through court battles which hopefully will reach the US Supreme Court...

Montana has said they intend on finding a squeaky clean individual as their lab rat to be the first to manufacture a "State Sponsored Firearm". Alaska has it written in their Bill that the Attorney General will defend any individual who is indicted as well as the State give full support in any case brought about by the Federal Government.

The implications of such a case of interstate commerce goes well beyond just firearms...In essence it will gut the Federal Government's Power to regulate in it's entirety,as they regulate and enforce unconstitutional laws currently,if the US Supreme Court Sides with the States and The US Constitution..

However,On the flip side, IF they side with the Federal Government on any such case involving interstate commerce and their rights to regulate....Well, It just could be the end of the Constitution and any possibility of going back to States Rights..

Replace the words "Slavery" with "Firearm" and when I look at history it reminds me to take a good look around because this is as close to 1860 as you will EVER get without building a time machine!

One must remember, The Civil War was not fought to end slavery as they would lead you to believe. It was merely to allow such decisions to be made by the States...

Our current president has also made the statements he always envisioned himself as an Abraham Lincoln...Even was sworn in on Lincoln's Bible!

There is too much(what I call) "Posturing" occurring on both sides for it to simply be meaningless or to go away!..

We are about to see the United States get a dose of "Change" it will never forget..

I believe We might just be living in a very historical period in time...We just don't know it yet:tinfoil:

I'm from MT and have a lot of interest in this issue. The federal government also leverages the interstate commerce clause to prevent the use of medicinal marijuana by the States. See Gonzales v. Raich (previously Ashcroft v. Raich), 545 U.S. 1 (2005). I was recently in California (I had to go for work) where there is now a big push to legalize the recreational use of the drug in order to generate tax revenue for the bankrupt state. The rationale is that dope grown in CA and used within the state cannot be regulated under the commerce clause. Lawmakers in CA now believe that the left leaning administration will allow this and, in 2009, Attorney General Eric Holder announced that the United States DOJ will no longer prosecute medical marijuana patients and providers who comply with their respective state laws (Gonzales v. Raich - Wikipedia, the free encyclopedia). It will be very interesting to see how this plays out in the courts where one state (CA) wants to challenge the commerce clause in order to build an industry around illegal narcotics while other states (AK, MT, TN) want to manufacture intrastate goods that are already protected by the Constitution.

Actually, under current Federal law, you can make your own firearms without any Federal registration or licensure, so long as they are legal under the 1934 NFA, and you do not transfer them to another person.

So short-barreled shotguns, short-barreled rifles, select-fire and full-auto weapons are out, as are suppressors. However, most anything else is legal for the home hobbyist to build.

State and local laws may vary.

Man! Those are some options we are left with. Makes me want to run out and buy a machine shop.

As much as I am curious to see things play out in Montana, Watching what happens in Alaska will be more interesting. Especially since they "could" decide to allow the make and use of federally unregulated, full auto firearms. whether they do or not is another topic, but still...

So that leaves what? DDs and AOWs?

Does that mean I can build a USAS from a parts kit without registering it, or do I have to make each component of the gun from scratch?

I would say that you can count out DD's and AOW's. They are not going to let you build anything class 3 without the tax.
