HOUSE BILL 390

AN ACT to amend Tennessee Code Annotated, Title 39,

Chapter 17, relative to the right’s of handgun carry

permit holders.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 39-17-1308(a), is amended by adding

the following new appropriately designated subdivision:

( ) Of a loaded rifle or a loaded shotgun as defined in § 39-17-1301, or of a

loaded magazine or clip therefore while being transported in a motor vehicle by a person

authorized to carry a handgun pursuant to § 39-17-1351.

SECTION 2. This act shall take effect July 1, 2009, the public welfare requiring it.

I think so.....

It has already passed the House which is usually more of a challenge than the Senate on these type bills.

For some reason the Senate added an amendment that would make it only apply to vehicles you or your family owns...but maybe that will be removed before it is done.

It should not matter whether you own the car or not. What if its a rental? What if your car is being repaired and its a loaner. What if you normally drive a sedan but borrow a truck or 4x4 during hunting season?

Let the senators know that it should make no difference who owns the vehicle.

What is the intent of the amendment? I agree it should make no difference, but why did they add it? There had to be a reason.:screwy:

If that amendment is correct, it's absolutely absurd...

Lets see, so me and another TGOer are going to a shoot.

We each have HCP.

We each have 3 long guns in the car.

So HIS are legal to be loaded, but mine aren't, eh?

How does a LEO know whose is whose?

And etc...

But I can carry my loaded handgun in ANYbody's car. Actually, I can have 10 loaded handguns in ANYbody's car.

Just nuts...

I'm not sure why you should need a HCP to carry a loaded long gun in your car.

Actually not sure why you need any permit to carry any firearm in your car.

Well....really.....not sure why you need a permit to carry a firearm period, but that is another topic.

At one time I thought I heard about an amendment to allow those with a Hunting permit to have a loaded long gun as well. But that could have been a different bill.

Yes.

Another phrase I have learned watching the legislature lately.. "I move to substitute and conform to the house/senate bill."

I think that is usually done if a bill has passed one chamber and then is being heard in the other. Considering there haven't been any amendments to the bill, there shouldn't be a problem.
