Negative Outcomes

Another forum I frequent shares examples of negative and otherwise sub-optimal outcomes of real world events, and I thought it could be useful here.

“For awareness, education, and discussion: The Detroit Eastern Market Tailgate Shoooting.

An Innocent bystander was killed by a bullet that penetrated through an armed aggressor’s head first. A single shot fired by a concealed carrier into the head of an armed man who was threatening people with a handgun that he was in the midst of an altercation with. The innocent bystander was trying to diffuse the incident and was behind the armed aggressor.

Both people shot in the head by this single bullet died. The local prosecutor has decided the self defender won’t be prosecuted for any crime. The innocent bystander’s family is upset and their suing the concealed carrier in wrongful death civil suit is a strong possibility. Even if they do not sue him this man now has to live with the fact that he killed an innocent person and all the second guessing and other possible emotional, psychological, social, professional, and financial consequences that may stem from that. 

We don’t know what kind of bullet was fired but we know that with regularity even high quality hollow points will fully penetrate a human head while still retaining enough velocity to be deadly. The closer the muzzle is to the person shot the more likely this is to happen.

We live in a three dimensional world and backstops matter. We have to be mindful of everything in front of, around, and behind someone we can lawfully shoot in self defense. We even have to be mindful that there may be people we can’t see behind walls and other penetratable barriers (Ref the LA active shooter incident where a cop made several great shots but one miss that went through a wall and killed a teenaged girl)

As mentioned, the citizen defender has some protection from criminal prosecution by the legal doctrine of 
'transferred intent".  In turn this may provide standing for liability for civil charge, depending on the state.  Of course nothing protects the individual from a lifetime of regret.
