I am not sure what the code is, but if you work in an establishment that serves alcohol, you, by law, cannot drink on the premises even off the clock. I am not sure if that is just a Chattanooga law, but in the academy, that is what we were told.

Well I give up.. What we have here is a bunch of weekend warriors who think they are lawyers, & are now reading TCA's out of context.. It's like reading the bible you nimrods. Each law is subject to another, & needs to be read in proper context! That's why lawyers get paid so much, & why I called the Attorney General on all of these things before I aired my opinions.

For those idiots that say a Security Guard can't protect property with lethal force, yes you can, if the person resists arrest with a weapon or puts your life in danger. If they are running away from you while pointing a pistol back at you & firing, you can damn straight shoot them.. So, stop acting like the TCA codes cover every possible scenario, because they don't.

I have an Armed Security certificate, & I've spoken to the attorney general on all of this. What 'most' of you guys are is a bunch of "every other" weekend warriors who own guns but rarely shoot them.

That explains why the name of the forum is Tennessee Gun Owners, & not Tennessee Gun Shooters.

So this will be my last post on this forum, since there are too many know it all sheeple here for my taste. I'll go over to Warrior Talk, or a forum where people actually have tactical training & knowledge, instead of a rusty old Berretta that hasn't been fired since 1986 in their glove box!

If you'll notice I said you can't use deadly force to protect property unless it would also fall under self-defense. Someone using a firearm against use would fall under self-defense. However this applies to all citizens not just security guards.

I don't just quote T.C.A., I have contacted the AG myself a few times, directly and thorough my Rep. When you called him did he tell you legally he can't give opinions directly to citizens like he told me?

But if you wish to leave....this is one nimrod that's not going to miss you.... :screwy:

wow, he sure did get upset after only 26 posts. Oh well. Good thing I only own guns and don't shoot them otherwise I might be offended by his rant.

Mediabuster,no one here thinks they are a lawyer (well one of us does,but thats only because he is one :) ) or a weekend warrior.

And even though you said that,and called me a "nimrod" I still wont ask you to leave.I will however strongly suggest (since you said you were a security guard) that you read,and understand these laws for your protection!

You seem to have an interpretation problem here,and you are in for a big awaking when you use the wrong force to subdue someone,or use deadly force to protect property,etc.

Ill also remind you that the Castle Doc(and yes TN has one) will not protect you if you shoot someone thats fleeing.

Go watch Pearl Harbor to man up enough to know that you need to inform yourself here.

It is a local ordinance:

(a) The beer board shall have the power to revoke or suspend, and shall be charged with the duty of revoking or suspending, any permits issued by it, upon notice to the permittee and a hearing thereon, for any violation of any provisions of this article or any other ordinance, state law or regulation or federal law or regulation governing the operation of such establishments or when the permittee:

(13) Consumes or permits any employee to consume any alcoholic beverages while on the premises, or to be intoxicated while on the premises

The guy from the beer board pointed out that it says nothing about whether or not the employee is on the clock or not, so the employee is not to drink there.

To attempt in getting this thread back on track, here is the letter I wrote to Rep. Todd...

Representative Todd,

I want to thank you for the hard work and dedication that you have shown to represent the hundreds of thousands of HCP holders in the State of Tennessee by bringing forth a quality Restaurant Carry Bill in HB0962. I know that you are receiving a lot of pressure via amendments to distort the aim and spirit of the bill in order to either stifle or kill it altogether. I have watched you present the bill through the various committees and the last general assembly when the bill was presented.

I want to write a letter of encouragement for you to stick to your principles as you have in this legislation and know that we are behind you, whether the bill has an 11pm curfew or not.

Our main concern as HCP holders is the ability to maintain the safety of our loved ones and ourselves while enjoying a meal at finer restaurants in Tennessee without the fear of breaking the law or even worse, the ability to safely defend our family in a self-defense situation. Your bill allows us to legally do this, and I appreciate your fervent effort in leading this bill to pass.

I believe HCP holders have proven that we can safely eat in non-alcohol serving restaurants in Tennessee, and we would love the opportunity to patronize the finer restaurants that happen to serve alcohol. As a business professional that travels daily with a territory in Tennessee, Alabama and Kentucky, I can tell you that our neighbors have correctly given the freedom to restaurant owners and law honoring citizens to maintain safety and security while dining at the best restaurants. I can only hope my home state joins her neighbors. If I could assist you in any way to bring this bill into law, please do not hesitate to contact me.

Like I said before stickj, (but maybe you have trouble reading), you're quoting laws without reading them in context, & in consideration of other laws as if the attorney general never has to issue opinions. THAT makes YOU ignorant.. You also took what I said out of context regarding the use of force, & are trying to twist it. It's a tactic that liberals like to use, or half baked wannabee conservatives, otherwise known as "rhinos".. Dishonesty for the sake of winning an argument at any cost is the way Obama got into office. You're doing a good job mimicking him now..

There are a lot of those on this forum.. (Not all of you), but many of you are a sad embarrassment to the gun shooters community, those who truly champion the second amendment, & the ideas of our founding fathers..

This is still America for the time being, where at least some people still appreciate free speech. I know that even if you think I'm wrong, that the writers of this state's constitution as well as the US constitution would have backed what I'm saying, & dismissed your pandering to political special interests as cowardly & selfish at best..

You know strickj.. I realize that this pesky & challenging little article of the State of TN. Constitution keeps getting in the way of your argument, but wondered if you'd care to explain how kicking people out of the Chinese restaurant at 11pm so they can get shot on the way back from the parking lot is a "view to prevent a crime"?

I'll even give you an example to work with, & I want you to explain to me why gun owners should have to leave an hour before everyone else or put their gun in the car, & leave knowing that gun thieves could be waiting for people to do so at such a popular & family oriented restaurant.

This is not a corner bar mind you, but a popular family restaurant. There are more examples that are open even later, but I didn't want to overwhelm you.. Please explain to me how telling criminals when the guns will have to go in the cars, isn't just like telling the enemy when you will be withdrawing from a certain location in a war?

Couldn't you go play golf with the AG or the other tactical armed security guards with the shoulder patches and 5.11 packable jacket flip down id panels?

ok, I think I need to say something. MB, you are the one that said that you were not going to be posting here anymore. Some applauded, some made jokes about it. However, NOBODY said anything about kicking you off of here (at least not on this thread). I have to say that this whole discussion is getting out of control and downright CHILDISH. I really think that everyone needs to take the time to go back and read the "code of conduct" at the beginning of the forum. I took the liberty to cut and paste a select portion of which I think that in this forum has been totally forgotten, ignored, or overlooked. It states:

I am not playing this game. if you want to act that way, I do wish you would leave this whole forum. I am trying to chill this whole thing down but you seem to enjoy starting fights. it is not the actions of other people that turn people off from gun owners, it is the people that want to start fights and can't let go of a chip on their shoulders that makes people question the sanity of gun owners.

State Representatives are suppose to REPRESENT, not throw their own ideologies or personal opinions into the legislative process.. Its not their job to compromise, its their job to create bills that represent (there's that word again) the people.

Punisher is right about one thing.. I am flaming angry about the "compromising" that got us on the ropes in the first place.. Now you guys don't have to like me, you don't have to think I'm smart, or that I have any idea what I'm talking about..

I agree with you on the role of our reps, they are screwed up and have gotten way too much power, but the highlighted part there, from what I have read in the admin notes, is at least half of the reason that this site exists. We can debate, we can argue, but let's just do it in a friendly, respectful way. That is all I am asking.
