permit renewal double standard

sorry if this is in the wrong place mods please move if needed. I messed up and let my permit expire as did the wife, thinking we would be OK when we renewed as long as we had our paperwork.well I went and did my renewal and was told that I would have to wait until I got my new permit in the mail to be legal again. This was a shock to me and after some research I learned that I was wrong and that since the permit was expired I would have to wait for the paperwork to go through (upset, yes but I carried for years with out it what is a couple of months). anyway wife just went to get hers renewed last week (exp. 12/15) the ladies at the DMV signed and initaled her paper work as a vaild permit. have I been a victum of a double standard? I honestly think they signed her paperwork just because she was a women. We both went to the same place and were processed by the same lady at the DMV, my permit was only expired 5 days - hers was over 30 days. Is she legal now because her paper work is signed or could she be charged reguardless? BTW when I say hers is signed I mean it is hand written on the recipet "valid as permit" then signed by two people.

Once it's expired you are supposed to go back through the whole process. Seems odd that they signed off on hers though and not yours.

Actually if it is expired less than 6 months, you can still just do a renewal, but as the OP said, you can not legally carry until you get your new permit.

To the OP, I'm not sure if the lady signed your wife's on purpose or out of habit...no way of knowing for sure I guess. But if I was you guess I couldn't help but to wonder too.

If an officer looked closely at the paper work and her old permit...she might not be considered legal, since it would show a renewal date after the expiration date on the permit, regardless of what was signed. But doubt many LEOs would make a very big deal over what might be considered a clerical error.

They need to scrap the entire system and start over. Get some people up there who have a clue. As with everything else the state has their hands in, it is screwed up...

it takes probably 10 minutes to do a background check. hell, you can pay for one over the internet and get the results back in that time. so i fail to see what the problem is in nashville. i bet they just let all the paperwork pile up and now they are overwhelmed with new apps and renewals and cant catch up.

all that is compounded by the slip up that was made by a few employees not running the background checks and that let people slide through with renewals and first timers that were felons or had other outstanding issues that needed to be dealt with.

mousegunner had a thread somewhere so he could document on how long the wait was for a renewal. you might want to search on that to see the specifics on how much permit time he had left before it expired, when he filed and all that jazz.

My permit expired last June so when I got the renewal in mid April I sent it off immediately. June came and went no permit so I called the HCP office and they sent me a letter next day saying it was ok for me to carry as long as I had the letter with me.

This may or may not work for you as yours has already expired before you sent in your paper work. give them a call you never know..

Oh and my permit finally came back with 3 days left in July? So mid April-late July. When I first got my permit it took less than 5 weeks to get it back go figure!

Not sure if Tenn. has changed their policy but sent my renewal off 1/22 with birth certificate they said would not be returned. Week later birth certificate returned and couple days later a letter arrived that said would be my receipt and could be used as permit until my card arrived. Maybe they are there to help us.--Rightttttt- :tinfoil: Will let ya know when I get mine.--MP

it could be worse, we could be one of those states that doesn't get permits at all. I agree the system could use some tweaking (ok, a lot of tweaking) but knowing what I know about local, state and fed government bureaucracy and procedures after working in and around it for the past 1.5 years - I don't see it getting much better.

I hope everyone else here realizes that it is not a smart idea to confess to a criminal offense on the Internet like this. Carrying without a HCP can earn a person a serious amount of jail time and a mark on their record that very likely will not go away without a very expensive fight.

Carrying without a permit is a sure fire way to forever lose your right to get a permit.

Furthermore, we do have rules here and I suggest that the Original Poster read them again and pay particular attention to Rule #5 [link] where we strictly forbid discussion of illegal activities.

This sort of thing is not kosher and it gives the law abiding HCP holding community a black eye. I am appalled and extremely embarrassed by the fact that it was admitted to by one of TGO's members, especially in this day and age when so many media outlets are salivating at the chance to destroy our 2nd Amendment Rights.

Frankly, my first inclination is to permanently ban Mr. I Am Wood from TGO for having such careless disregard for the integrity of the TGO community. I'm going to have to discuss this some with the rest of the moderators to make sure that I'm not off track.

:D

....

All due respect for your sentiments (which I agree with) aside, it is nevertheless not a felony to carry without a permit, not even if caught several times. See TCA:

39-17-1307. Unlawful carrying or possession of a weapon.

Understood and thank you for the correction.
