Restraining Order Question

My ex is fawking nuts.

There, I said it. Anyways, back home she keyed my dragracing car...with a pickaxe. So much for my trip down to Rockingham over spring break...

Long story short, I'm debating getting a restraining order against her so she cannot come near me or my home. How (if at all) will it affect me already having CCPs and will it hurt me in a couple years when I go to get my TN HCP or NC CCP?

I'm sure some of the legal beagles around here can give you more details. I can't think of any negative impact on you unless she decides to retaliate by getting the above mentioned order of protection.

Yeah, I was kind of worried about that as well, but my friend told me of a time that she had to take one out on her ex. He tried that and they laughed in his face, saying the one that if he just followed the one she took out on him then he wouldn't have any worries.

In all honesty Restraining Orders are not worth the paper they are written on.

Did you file any criminal charges on her for the damage to your car? If so the judge could order her to stay away from you as part of the sentence on that charge.

But even with that, like restraining order, is he violates it...she has simply violated a court order and would have to go before the judge again for what, if any, punishment she would get for violating it.

Now if a person violates an Order of Protection, they can be arrested on the spot. Not sure if you would be able to get one on her for this or not, trouble would be is she follow suit by getting one on you.

The car is still in Dad's name...property tax bill goes to him instead. :screwy: He did file charges but they are still "investigating" the case (she keyed her name in the hood). I'm debating just waiting until any court orders are issued to prevent giving her any ideas.

I wouldn't say they are entirely worthless. Creating a legal record of a situation like this early on can be helpful in case the situation escalates further.

Hope you can get it all taken care of without too much trouble..or more damage...

True enough.

I guess I just meant more in the case of actually keeping someone away from you because of the fear of any consequences...at least immediate consequences.

I actually didn't piss her off. She is just nuts. She cheated on me, got knocked up, "miscarried" it, left me for another guy, and went schitzo on me a year later when I started dating my current g/f here in Knoxville.

I hate to have to warn you but the day after you file a restraining order, you will have one filed in return or an Order of protection filed on you.

If you can't cut off all communications and move....life is going to get miserable for you dude. Seen it to many times in my previous career as an investigator.

Already tried that...I don't live at home anymore, and she knows that.

And people wonder why I wanted a CCP so badly...

EDIT: Oh, and she does not know that I have them...for obvious reasons.

That's awful, but you sound just like one of my buddies.

So she traveled hundreds of miles to harass you?

You don't understand what I'm saying but when dealing with psycho wenches, you leave the state, you get hundreds of miles away, you get off the net for a while....and yeah, I know, I know, no woman is going to make me have to leave where I live and do what I want to do.

Brother, everything is in their favor and they can and will say and do anything to ruin you!

Seen it many times. If you want to be able to own a handgun, much less carry one, go Star Wars on her and get far far away!

Take a year off and visit friends in Washington State

The car is at my parent's house in Bumfawk, NC. She is blocked on my Facebook, my cell, and my folks' have an unlisted number.

Sorry, I should have specified she lives in NC as well. We dated when I was still in high school.

Maybe you should have some people start spreading the word of your recent death.
She'd try to picket the funeral...we went to the same church.

Crazy?? You mean, thats not normal behavior? :D

Sounds like a rough time. I wish you the best, hopefully you've learned a thing or two you can apply to the future. Best thing you can hope for is that some other poor sap gets caught up in that web so the focus gets drawn away from you. Got a buddy you can throw under the train?

Sadly, nope. On a side note, her dad killed himself by laying down in front of an Amtrak train.

She wasn't crazy until my dumbfawk buddy informed her I had a hot new girlfriend. I repaid him the favor by, well I shouldn't say because they're still investigating.
