The Sec. here at my work gave me this form with my pay check stub today, and said that I need to fill this out and get it back to her. I asked her what it is and she said, "It is a form the government is making us have every employee fill out to prove our work eligibility, even though we are american citizens.

It just seems odd. There is nothing really weird on the form, it is just information that my employer already has for me. This form just seems redundant.

Has anyone else seen or heard of these?

Yeah, every employee has to fill these out and show the employer some form of id to prove they can legally work in this country. If a person is on a work visa, the employer is supposed to update the documentation whenever the visa is renewed. For citizens, you only have to show id once. Most places give these out when you start employment along with your W4 etc.

Right, that is what I was told, but I don't understand the point of making me fill it out. My employer has all the information that this form is asking for. At the top left of the form it says "Department of Homeland Security, U.S. Citizenship and Immigration Services"....really, wow, thank god we have that department handeling these forms.

I have to fill out: My name, address, date of birth , social security number, and check the box that says I am a citizen of the United States, and then sign it. That is it.

I have been with this company since April of 2000, and they already have all this info.

Just seems odd to me.

The I-9 is a standard form that employers use to verify eligibility for work. It has been around since the mid 1980's. Every employer is supposed to have one on file for each employee.

Your employer should have had you complete one when you were hired back in 2000. If you did not fill one out then, this may be the reason you are getting one now.

the government in all their wisdom changed some wording on them and the old ones are no longer legal. and as far as them filling it out for that would be illegal. that is what we where told when we filled ours out in January.

Well, the company is just covering their a$$. They are currently in slight violation. That form should have been filled out in April of 2000. It's been required for quite some time. I'd guess the Feds are starting to actually check on the paperwork.

Considering the employer is supposed to fill out the majority of the paper that would seem a bit odd. I had to fill one out when I hired MY SON. God knows I'm not sure if he is a US citizen. ;)

Is the employee or the employer supposed to fill that out? I ask because I have never seen that form before.

First, it is not redundant. The employer needed the same information, but for a different purpose. The employer is required by federal law to obtain a completed I-9, which also requires the employer to actually examine the document(s) you present as proof for the form. So, unlike collecting the information for purposes of payroll, benefits, etc. that they have already done, the I-9 requires you to certify (under penalty of perjury) that you are, in fact, eligible to work in the U.S and requires the employer to examine the proof document(s) to insure (haha!) that the documents are legitimate.

Again, the employer has the information on the form (probably other than the Driver's License or State ID -- unless they collected for I-9 purposes earlier), but they don't have you certification without the I-9. In addition, the feds have not increases enforcement of the I-9 requirements. However, the new Tennessee law (went into effect January 1, 2008) prohibiting employment of illegal aliens may be the source of the employer's need to update the I-9. You can see the article regarding no-match letters and the new TN law I wrote for the Nashville Chamber at the link below (second article).

Employee fills out the top part, and provides the forms of ID from one or more of the lists. Employer fills out the rest of the form.

One should have been completed when you were hired. If not, then your employer could be found in violation of law if INS ever does an inspection on their files.
