WASHINGTON, DC--(Marketwire - January 29, 2009) - Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has filed a lawsuit against newly sworn-in Secretary of State Hillary Rodham Clinton on behalf of U.S. Foreign Service Officer and State Department employee David C. Rodearmel, (Rodearmel v. Clinton, et al., (D. District of Columbia)). The lawsuit maintains that Mrs. Clinton is constitutionally ineligible to serve as Secretary of State and that Mr. Rodearmel cannot be forced to serve under the former U.S. Senator, as it would violate the oath he took as a Foreign Service Officer in 1991 to "support and defend" and "bear true faith and allegiance" to the Constitution of the United States.

If our government were still a government of principle, she would never have been nominated. Since it is not, and hasn't been for a long time IMO, I suspect this will go nowhere (and that he will probably lose his job over it somehow).

Lets say for sake of discussion, that this lawsuit goes through and Hillary is booted out of the position. Her NY Senator slot has already been filled and her replacement sworn in. Does that leave Hillary out in the cold? Or does the replacement Senator step down?

never mind just read the info. So if they don't toss her out then the the constitution according to these f**ks is nothing more that a piece of ass wipe.

Hillary is Constitutionally barred from being appointed as S of S.

"If you think this would have come up before, you’d be right. President Nixon was confronted with it when he wanted to appoint Senator William Saxbe to Attorney General. The solution derived, called the “Saxbe Fix,†reduced the pay level of the cabinet position back to where it was before the hike. Later, Lloyd Bentsen served as Treasury Secretary after the “Saxbe Fix†legislation reduced the salary of that office to its level immediately before Senator Bentsen’s Senate term had begun."

Hillary is our Sec. of State.

This is an old argument and has been "fixed" several times over several administrations.

Actually, she didn't vote to raise the salary. The salary raises were done by executive order.

I think the law suit does have a chance. Cutting the pay scale back or not. The constitution is very clear on this and Saxbe was not the same scenario. I also don't see

Judicial Watch wasting there resources or time if they did not think they had a shot. Ifor one am sick and tired of the Clintons the kennedy's and Bushes. These friging families think thier dam royalty and postions are theres for the asking.
