Got my C&R... now for all the stupid questions

Well like the title says I got my C&R in the mail today... And I've got some questions.. First of all I thought all the info about the bound book and everything would've come with it, but I guess I have to request it..?? Will that packet explain everything about selling firearms that were bought useing my C&R?? I understand that you can't use it to make a living buying and selling, but what about hook'n your friends and family up with great deals??... I'm sure I have more stupid questions just cant remember them now...

MidwayUSA is now your pimp! It wants teh monies! The deals are not with the guns, but with the other supplies that you can now get at deep discount. I made my bound book with $4 worth of supplies at Staples. Bound is a loose term by definition...it does not mean a glued spine. Heck...everyone I know uses transparent pockets with a plastic binding. Pages just slide in there.

if you haven't figured it out yet....DO NOT sign your FFL. Make copies (a lot) ASAP!

So if I bought say 10 Mosins, I couldn't sell the 5-6 that I didn't want? I assume the packet will answer these questions, I just don't have it yet..

Your packet will answer a lot of questions, also you can contact your local ATF office if you have any questions.

As stated before, a C&R license allows you to acquire C&R firearms for your collection. It is not a license to deal or do business in C&R firearms. That would require an 01 FFL.

You are allowed to dispose of C&R firearms from your collection, but you must be very, very careful how you do this. Using your example above: buying 10 Nagants and then turning around and selling 5 or 6 of them to others would likely have the ATF view you as an unlicensed dealer. You can use your imagination as to what would happen next. It won't be pretty.

If you are wanting to hook up your friends and family with good deals on firearms, you need to apply for an 01 FFL. You cannot use your 03 FFL for that purpose.

If there is even the slightest chance that it would appear that you are trying to turn a profit or are hooking up your friends, you better believe the ATF will see it that way. You may or may not get caught, by why take the chance?

I had to have some things on my record cleared up, so it took me alittle longer than most, it was still alot faster than my carry permit...

4-6 weeks usually.

Pick up a Shotgun News. Look for anyplace that sells C & R guns. Make several copies up your unsigned license. Sign the copies. Mail them to the dealers, with a note to add you to their mailing list. Then order what you want to collect. Let the good time roll.:P

Just to let you know, Some places take a faxed copy or even an e-mailed copy of your C&R

Brownell's makes a pretty decent "bound book" you can buy, check their web site. Also, as far as buying and selling, if you're doing it with other C&R holders then that's just all part of collecting. You can sell a rifle to a buddy as long as you're not making a profit and you're doing it because you either didn't want it in your collection anymore or wanted to add something else to your collection. Just make sure that you sell em' for what you paid and not a cent more and record it in your bound book and don't do it a lot or as has been said, you'd be an unlicened dealer and that's a big NO NO.

Nope. Profit motive in buying and selling will get you in hot water. It's OK to make a buck when you sell. The applicable laws are in the introduction section here: http://www.atf.gov/firearms/curios/1972-2007/introduction.pdf

I don't see any prohibitions against profit there.

At least one ATF publication, I don't recall if it was printing of Q&A in the back of the C&R book, or elsewhere, specificly states that it is OK to profit on a sale. The prohibition is in dealing (repeated sales) with a C&R.

I have been thinking about getting a license. I have a question just out of curiosity. What happens if you let your C&R lapse? Do you surrender your collection? Just out of curiosity.

You keep your C&R collection. The license is only used to facilitate the acquisition of firearms for your collection.

In other words, nothing happens if you let your license lapse. You don't even have to send in your records like a regular FFL would.
