Suggested Personal Firearm Bill of Sale

The following form is provided to members of TGO as a courtesy and is a recommended private party Bill of Sale for the transfer of firearms.  Please note the emphasis on the word recommended.  While this form certainly has benefits for both the buyer and the seller, there is no legal requirement for it to be used.

 

Arguments For:

  • In the event that the firearm transferred to the buyer is eventually used in the commission of a crime, the seller has a record of having performed reasonable due diligence to document who the firearm was sold to and that the buyer attested to being able to legally own the firearm.  This document could be provided to the authorities if the seller was ever investigated due to having been listed on a Form 4473 as being the original purchaser of the serialized forearm.
     
  • The buyer is likewise provided with a record of who sold the firearm to them in the event that the firearm is ever determined to have previously been stolen or used in a crime.

 

Arguments Against:

  • It is not required by law.
     
  • Some buyers prefer private party sales simply because there is no documentation in the hands of a government entity of that transaction having ever occurred.
